ORDINANCE NO. 1718 AN ORDINANCE GRANTING A SPECIFIC USE PERMIT TO CONSTRUCT AND OPERATE A SWIMMING CLUB AND TENNIS CLUB TO THE DOLPHIN SWIM CLUB OF PARIS, INC., UNDER ORDINANCE NO. 1710 OF THE ZONING ORDINANCES OF THE CITY OF PARIS, FOR A THFZEE ACRE TRACT LOCATED 250 FEET EAST OF THE E.B. LINE OF 33RD STREET, S.E. AND IMMEDIATELY EAST OF THE IN- TERSECTION OF ALLEN STREET AND 33RD STREET, S.E.; AN ORDINANCE DE- TAILING THE CONDITIONS UNDER WHICH SUCH SPECIFIC USE PERMIT IS ISSUED AND SPELLING OUT THE RULES AND REGULATIONS FOR THE OPERATION OF SUCH SWIM CLUB AND TENNIS CLUB, A1VD RETAINING THE RIGHT TO MAKE ADDITIONAL CONDITIONS SHOULD EXPERIENCE IN THE OPERATION OF SAID CLUB MAKE THE SAME NECESSARY; AN ORDINANCE FIXING THE RULES FOR THE CONSTRUCTION OF SAID SWIMMING POOL AND BATH HOUSE; AN ORDINANCE FIX- ING THE RULES AND REGULATIONS TO REMAIN AS IS UNLESS CHANGES ARE APPROVED BY THE CITY OF PARIS, TEXAS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Dolphin Swim Club of Paris, Inc., a corporatio:n, has filed its applicatio:n for a specific use permit, authorizing the use of a three acre tract of land described in applica:nt's pe- tition as and for a swim club and tennis club, pursuant to Section 12, Paragraph 110, Sub-paragraph 26, of Zo,ni;ng Ordinance No. 1710, of the City of Paris, Texas; and, WHEREAS, the property referred to is located in a reside:ntial district; and, WHEREAS, after a full and complete hearing before the Planning a:nd Zoning Commission and the City Council of the City of Paris, the City Council is of the opi:nion that said swim club a:nd tennis club could be so operated as to be an asset to the neighborhood a,nd could be so operated as to be a detriment to the neighborhood; NOW, THERE- FOR E, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section l. That the City of Paris issue to the Dolphi:n Swim Club of Paris, Inc., and it does hereby issue a specific use permit authorizing the use of their property for a swim club and tennis club, in accordance with Sectio:n 12, Paragraph 110, Sub-paragraph 26, of the Zoning Ordinance of the City of Paris, being Ordi:nance No. 1710, upon the followi:ng terms a:nd co:nditions: (a) That the Dolphin Swim Club of Paris, I;nc. has filed at the hearing a folio or file contai:ni:ng various i:nstru- ments and has incorporated said i:nstrume:nts as part of its application for said specific use permit. That among the instruments contained in such folder is the Dolphin Swim Club of Paris pool regulations, co:nsisting of Pages 1 and 2. That this permit is granted on the express co:ndition that these pool regulatio:ns will not be changed by the officers or the membership of the Dolphin Swim Club without the consent of the City Council of the City of Paris, Texas. (b) That in said file or folio the Dolphi:n Swim Club has in- cluded a drawi:ng of the area co:ntaini:ng the three acres, showi.ng the same to be 189 feet wide and 692 feet long, plus a road easement of 39 feet in width and 250 feet long leading from 33rd Street, S.E. to its 3 acre tract.
