<br />AN ORDINANGE GONTAINING A HEARING ON PROPERTIE5 LOCATED
<br />AT 613, 619, and 623 lOTH STREET, S. E„ IN THE CITY OF PARIS, BE-
<br />LONGING TO J. M. HIX; AND AN C?RDINANCE OF THE CITY COUNCIL
<br />FINDING THE MATERIALS REMAINING IN THE PREMISES TO CONSTI-
<br />TUTE A NUISANCE AND TQ BE A FIRE HAZARD TO LIFE AND PRO-
<br />PERTY AND A HAZARD TO THE LIFE AND WELFARE OF THE INHABI-
<br />TANTS OF THE AREA, AND QRDERING SAID RUSBISH, LUMBER~ AND
<br />REFUSE FROM THE HOUSES, WHICH WERE T4RN DOWN, REMC?VED
<br />FRQM THE PREMISE5p IN ORDER TO ABATE SUCH NUISANCE,
<br />WHEREAS, a Public Hearing was, on this the llth day of November,
<br />A. D. , 1963, called to order by the Mayor of the City of Paris, C. L.
<br />Walker, at 7:00 o tclock P. M., in the City Council Room, in the City of
<br />Paris, Texas; and,
<br />WHEREAS, the City Council finds that the Building Hazard Inspection
<br />Committee fixed a date for hearing on the resolution referred to the
<br />Committee by the City Council on October 14, 1963, and that said Committee
<br />fixed said hearing at 1:30 P. M, , on October 30, 1963, and the hearing was
<br />had thereon. That proper notice was given to the owner and to the tenants
<br />in the structures located at 613 lOth Street, S. E. and 623 lOth 5treet, S. E. ,
<br />and that said hearing was held in accordance with Ordinance No. 1470,
<br />passed by the City Council on the 9th day of March, 1959. That at said hear-
<br />ing, the Committee heard evidence from several persons residing in the
<br />immediate area of the properties involved, and had the benefit of pictures
<br />taken of various portions of the three structures and various portions of
<br />the premises involved. That the members of said Committee inspected and
<br />visited the structures and premises in question, and that said Committee
<br />found that each of the three structures were in such state of deterioration
<br />and dilapidation to create a serious fire hazard to life and property; that
<br />each of said buildings was dilapidated and was dangerous to life and pro -
<br />perty and was a dangerous structure to life and property. That said bui.ld-
<br />ings are in such a state of dilapidation and decay that neither of the three
<br />structures are capable of repair, The Committee further found that the
<br />condition of the premises and structures involved were such that the
<br />Committee recommended to the City Council that they be declared a nui-
<br />sance and that the owner and occupants be ordered by the City Council to
<br />tear down and remove the same from the lots involved. That said Committee
<br />filed a complete report of its hearing and its findings with the City Clerk of
<br />the City of Paris, on the 4th day of November, 1963, and furnished a copy
<br />to the owner, at 628 6th Street, S. E. , and to the tenants, at 613 lOth Street,
<br />S. E. and 623 l Oth 5treet, S. E. ; and,
<br />WHEREAS, the City Council has fully heard and considered the testimony
<br />presented upon this hearing and the complete transcript of the testimony re-
<br />ported by the Building Hazard Inspection Committee; NOW, THEREFORE,
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS:
<br />Section 1, That the structures at 613, 619, and 623 lOth Street, S. E„
<br />have been torn down by the owner, and that the two structures containing
<br />tenants have been vacated by the tenants. That much of the lumber is piled
<br />against the fence of adjoining lots and disorderly and scattered about the
<br />premises, and that the nails have not been removed from any of said
<br />lumber, and that the premises are left unguarded, which permits children
<br />to play on and about said stacks and piles of lumber. That the rubbish,
<br />lumber, and other materials are dangerous to life and property, and that
<br />the same constitute a fire hazard to life and property, and that the same
<br />is hereby declared a nuisance. That the owner, J. M. Hix., is hereby
<br />ordered and directed to remove said lumber, timber, rubbish, and other
<br />items, which are the remains of the razed structures, from the premises,
