1530 ORD DECLARING NECESSITY AND ORDERING IMPROVEMENT OF CERTAIN STREETS AND PORTIONS THEREOF IN COP

Section 3, The City Council of the City of Paris deems it advisable and hereby determines to proceed under and exercise the powers, terms, and pro- visions of Article 1105b, R. C. S. , 1925, and the provisions of the Charter of the City of Faris adopting said sta.tute of the State of Texas. Section 4. The costs of said curb and gutter shall be paid as follows: (a) The cost of the curb and gutter, in the amount of $1.25 per center- line front foot, assessed on a front foot basis, shall be assessed against the respective property owners in accordance with the sta.- tutes of Texas and the Charter of the City of Paris herein referred to, and the cost of driveway approachesy in the amount of 40~ per square foot shall be assessed against the respective abutting pro- perty and the real and true owners thereof, in accordance with the statutes of Texas and the Charter of the City of Paris herein re- ferred to. When the improvements herein ordered for the streets designated above and portions thereof, have been completed and accepted by the City of Paris and the State Highway Department of the State of Texas, the amount of the assessment against each pro- perty abutting thereon, and the real and true owner thereof, sha.ll be and become payable in five (5) equal annual insta.llments, due re- spectively thirty (30) days after one (1), two (2), three (3), four (4), and five (5) years from the date of accepta.nce by the City, together with interest on each insta,llment from said date of acceptance until paid, at the rate of six per cent (60/6) per annum, payable annually; pr ovided, however, that the owners of any of said property shall have the privilege of paying all or any of said installments at any time before maturity thereof, by paying the tota.l amount of the principal of such installments, together with the interest accrued thereon, to the date of payment. Further, if default is made in the payment of any of said installments of principal and interest, promptly as the same mature, then at the option of the Cityof Paris, the entire amount, together with reasonable attorneyts fees and all collection costs incurred, shall be and become immediately due and payable. (b) That all of the remaining costs of the improvements to said re- spective highways and/or streets is, by agreement between the City of Paris and the Highway Department of the Sta.te of Texas, to be borne by the Highway I?epartment of the State of Texas. Section 5. The City Clerk is hereby directed to cause to be prepared a notice of the enactment of this ordinance and to file said notice among the Mortgage or Deed of Trust Records of said County.
