Section 3, The City Council of the City of Paris deems it advisable and <br />hereby determines to proceed under and exercise the powers, terms, and pro- <br />visions of Article 1105b, R. C. S. , 1925, and the provisions of the Charter of <br />the City of Faris adopting said sta.tute of the State of Texas. <br />Section 4. The costs of said curb and gutter shall be paid as follows: <br />(a) The cost of the curb and gutter, in the amount of $1.25 per center- <br />line front foot, assessed on a front foot basis, shall be assessed <br />against the respective property owners in accordance with the sta.- <br />tutes of Texas and the Charter of the City of Paris herein referred <br />to, and the cost of driveway approachesy in the amount of 40~ per <br />square foot shall be assessed against the respective abutting pro- <br />perty and the real and true owners thereof, in accordance with the <br />statutes of Texas and the Charter of the City of Paris herein re- <br />ferred to. When the improvements herein ordered for the streets <br />designated above and portions thereof, have been completed and <br />accepted by the City of Paris and the State Highway Department of <br />the State of Texas, the amount of the assessment against each pro- <br />perty abutting thereon, and the real and true owner thereof, sha.ll be <br />and become payable in five (5) equal annual insta.llments, due re- <br />spectively thirty (30) days after one (1), two (2), three (3), four (4), <br />and five (5) years from the date of accepta.nce by the City, together <br />with interest on each insta,llment from said date of acceptance until <br />paid, at the rate of six per cent (60/6) per annum, payable annually; <br />pr ovided, however, that the owners of any of said property shall <br />have the privilege of paying all or any of said installments at any <br />time before maturity thereof, by paying the tota.l amount of the <br />principal of such installments, together with the interest accrued <br />thereon, to the date of payment. Further, if default is made in the <br />payment of any of said installments of principal and interest, <br />promptly as the same mature, then at the option of the Cityof Paris, <br />the entire amount, together with reasonable attorneyts fees and all <br />collection costs incurred, shall be and become immediately due and <br />payable. <br />(b) That all of the remaining costs of the improvements to said re- <br />spective highways and/or streets is, by agreement between the City <br />of Paris and the Highway Department of the Sta.te of Texas, to be <br />borne by the Highway I?epartment of the State of Texas. <br />Section 5.
