concrete gutter or concrete curb and gutter, shall and must be built, con-
<br />structed, or reconstructed in accordance, or in conformity with the form and
<br />design of such existing structure section, on auch existing curb, gutter, or
<br />curb and gutter section on such side of such street and block thereof.
<br />Section XV: Sidewalks, Curb, Gutters, Curb and Gutters, and Driveways,
<br />Replacements
<br />When a permit has been issued for the removal, or demolishment of an
<br />existing concrete curb, concrete gutter, concrete curb and gutter, or concrete
<br />driveway, for any purpose, same will be replaced in accordance with this or-
<br />dinance, meeting all requirements for new construction, unless authorization
<br />by the City Council has been given to eliminate same.
<br />5ection XVI: Frost Protection
<br />No concrete shall be poured when the air temperature is below 40 degrees
<br />F. unless the aggregates and water are heated to produce a temperature of
<br />not less than 60 degrees F. and not more than 90 degrees F. at the time the
<br />pouring is done, and unless adequate provisions are made for maintaining pro-
<br />tection against freezing of the concrete for at least seven (7) days imniediately
<br />following the pouring thereof. No concrete will be poured on frozen sub-grade.
<br />Section XVII: Barricades and Warning Signs
<br />The holder of the approved permit shall provide, erect and maintain, all
<br />necessary barricades, suita.ble and sufficient red lights, or flares, and danger
<br />signals, on all work under construction or repair, and on all materials, equip-
<br />ment, and forms used in construction or repairs, from sundown to sunrise each
<br />day, and every day that the construction or repair, or materials and forms are
<br />a hazard to the Public safety. The holder of the permit shall indemnify the
<br />City of Paris against all real or asserted injury to persons or property, arising
<br />out of, or accruing from the construction or repairs, or any oDndition attendant
<br />upon such construction or repair work,
<br />Section XVIII: Fees
<br />A fee of two ($2. 00) dollars will be cha,rged for each permit issued under
<br />this ordinance.
<br />Section XIX: Bonds
<br />No person, firm, or corporation, or any of its agents, will be eligible for
<br />a permit to work within the right-of-way of the Public streets or alleys of the
<br />City of Paris, under conditions of this ordinance, unless said person, firm, or
<br />corporation, or its agents, ha.ve on file in the office of the City Engineer, a
<br />bond in the sum of one thousand ($1, 000. 00) dollars, payable to the Gity of
<br />Paris, Lamar County, Texas, iasued by a Surety Company, approved by the
<br />City Attorney for the City of Paris, and licensed to operate in the Sta,te of
<br />Texas, which bond shall condition that the party so bonded will fulfill all the
<br />requirements of this ordinance.
<br />Section XXo Appeal
<br />Any person, firm or corporation, aggravated or affected by any decision at
<br />all of any Administrative affice of the City of Paris, acting under and by virtue
<br />of the provisions of this ordinance, may appeal to the City Council of the City
<br />of Paris by filing with the Officer from whom the appeal is taken, and with the
<br />City Clerk of the City of Paris, a notice of appeal, in writing, specifying the
<br />grounds thereof. Such appeal shall sta.y all proceedings in the furtherance of
<br />the action appealed from, until the next regular meeting of the City Council,
<br />unless such appeal is ta,ken up for consideration by said Council before such
<br />regular meeting. When in its judgment, the City Council decides that said
<br />appeal involves an application for special exception to the regulations of this
