OHDINANCE AlD. ~ ~ . <br />AN ORDINANCE PROVTDING FOR THE MANAGEMENT, CONTRDL, AND MAINTENANCE OF <br />THE PARIS PUBLIC LIBRARY, F7R TNE APPOINTMENT OF A BOARD OF DIREGTORS TI-IERFAF <br />AND DEFINING THEIR DUTIES AND FOWERS. <br />BE IT ORDAINED BY THE CITY GOUNCIL OF THE CITY OF PAFiTS: <br />1. That the property consisting of a lot and building thereon on <br />South Main Street, donated to the City of Paris by J. J. Culbertson and wife, <br />Emily Lee Culbertson, for library purposes, be, and the same is hereby desig- <br />nated the PARIS PUBLIC LIBRARY. <br />2. Said property having been accepted by the City upon certain terrns <br />and conditions contained in the deed to the City, among other things requiring <br />the City to manage, operate, and maintain said property as a public library, <br />the management, control, and operation of the Paris Public Library, is hereby <br />vested in a Board of Directors consisting of not less than five members nor <br />more than nine members; as many as two of which members may reside in the <br />County of Lamar, outside the city limits of Paris. Five members shall be <br />citizens of Paris, Texas. All rnembers shall be recommended by the Library <br />Board ar►d shall not take office until confirmed by the City Council. The <br />names of such directors shall be submitted to the City Council at a regular <br />meeting. Such directors shall serve for a period of one year or until their <br />successors are appointed. <br />The Library Board may accept resignations or propose a new director. <br />Vacancies resulting from resignations or any other cause shall be filled as <br />provided above upon the recommendation of the Library Board but the number of <br />directors shall be not less than five nor more than nine. <br />The Mayor of the City of Paris shall be ex officio chairman of the <br />Board. When, and if, absent from any board meetings, copies of such reports <br />as rnay have been made to the Board of Directors, together with copy of minutes <br />of board meeting, shall be mailed to the Mayor at his official address. <br />3. As required by the terms of the grant of said property to the City <br />and the City*s acceptance thereof, the City Council 5ha11 annaally, at the <br />regular time for raaking appropriations, appropriate out of the curxent funds <br />of the City, aminimum of Three Thousand ($3,000.00) Dollars for the operation <br />and maintenance of the Paris Peablic Library. <br />When requested by the City Manager, the Library Directors shall submit <br />to the City of Paris a proposed budget which in the opinion of the Board i5 <br />requisite for the proper conduct, maintenance and operation of the Library for <br />the next City fiscal year. The appropriation for the Paris Public Library <br />shall be paid by proper warrant to the Paris Public Library in equal monthly <br />payments. <br />4. The Board of Directors of the Paris Public Library is authorized <br />to expend said sum in the operation of the PariS Public Library. Said Board of <br />Directors shall make monthly reports to the City Council containing detailed <br />statements of expenses incurred and paid in the operation of the Library. The <br />Board of Directors of the Paris Public Library shall have and exercise full <br />control of the money that shall be appropriated and turned over to them by the <br />City for the operation of said public library. Said Board of Directors shall <br />have r►o authority to make any contract or incur any indebtedness on the part <br />of the City of Paris and is expressly limited in making contracts and purchases <br />on account of the Paris Public Library to such as can be complied with and paid <br />out of the mc>ney appropriated for that purpose by the City Council. In no <br />event shall the City of Paris be liable for any debt or liability on account of <br />the Paris Public Library, its liability being expressly limited to the annual <br />appropriation hereby provided for. <br />5. The Board of Directors af the Paris Public Library is hereby au- <br />thorized and empovrered to appoint and employ a librarian, assistant librarian, <br />secretary, and such other agents and employees as may, in its judgment, be <br />necessary to the proper conduct and operation of the Paris Public Library, in <br />accordance with the terms of the gift of said property to the City of Paris, <br />and to fix salaries and wages to be paid to such employees out of the fund <br />provided by the City for that purpose. <br />
