QUIRED BY ARTICLE 1105b, REVISED CIVIL STATUTES OF TEXAS AND THE CHARTER OF THE CITY OF PARIS ADOPTING SUCH STATUTE, DE.. TERMINING THAT A PORTION OF TI3E COSTS SHALL BE BORNE BY THE CITY AND THE BALANCE THEREOF aHALL BE BORNE BY THE ABUTTIIVG PROPERTIES AND THE OWNERS THEREOF, PROVIDING FOR THE AS5ESSMENT OF THE PORTION OF THE COSTS TO BE BORNE BY THE PROPERTY OWNERS, PROVIDiNG FOR THE FIXING OF A LIEN TO SEGURE THE PAYMENI' OF SUCH ASSESSMENTS, SETTING THE TIME AND MANNER PROPOSED FOR THE PAYMENT OF SUCH GOSTS, DIRECTING TH.E CITY CLERK TO CAUSE A NOTICE OF THE ENACTMENT OF THIS ORDINANCE TO BE FILED IN THE MORTGAGE OR DEED aF TRUST REGORDS OF LAMAR COUNTY, TEXAS, BE IT ORDAINED BY 'THE CITY COUNCIL OF THE CITY OF PARIS: Section 1, Tha.t a necessity exists for the improvement of those cer- tain portions of the public street hereina.fter listed, by scarifying the existing flexible base, adding additiona.l flexible base where needed, shaping and com- pacting the flexible base, priming the surface with aspha.lt, applying a wear•• ing surface of asphalt and coverstone, and rolling the surface and brooming the same after the application of the coverstone, and such improvements are hereby ordered, the portions of the public street to be so improved being de s ignate d and define d a s follow s, to -w it: (1) 29th Street, N. E„ from the South Boundary Line of East Cherry Street to the North Boundary Line of East Price Street, Section 2. The street and portions thereof shall be improved and fini shed as set out in 5ection 1, above. Section 3. Tha.t the City Manager has filed an estima.te of the cost of the above improvements, the same to be done by the forces of the City of Paris, and has estimated the cost of seventy-five cents (750) per front foot for said improvements, and in addition the use of machinery now owned by the City of Paris. Section 4o The City Council of the City of Paris deems it advisable and hereby determines to proceed under and in exercise of the powers, terms, and provisions of Article 1105b, R, C. S. , 1925, and the provisions of the Cha.rter of the City of Paris adopting said statute of the State of Texa.s. Section 5, The costs of said improvements shall be paid as follows: (a) The City of Paris shall pay all costs of any necessary drainage installa.tions and all of the additional costs in excess of fifty cents (50~) per centerline foot on said project. (b) The remainder of the costs of said improvements, in the amount of fifty cents <50~) per centerline front foot shall be assessed against the respective abutting pro•. perties and the real and true owners thereof, in accordance with the statutes of Texas and the Charter of the City of Paris herein referred to. When the
