ORDINANCE N0. 1329 . <br />Whereas, The Public Works Department of the City of <br />Paris is desirous of obtaining on behalf of said City a pri- <br />vate crossing easement or license for the construction and <br />maintenance of an access road across the St. Louis-San <br />Francisco 8c Texas Railway Company right of way and railroad <br />tracks at a point 1372 feet North of the centerline of Center <br />Street at its intersection with the centerline of said rail- <br />way right of way; and, <br />Whereas, said railroad company is willing to grant <br />such easement and license upon the terms and conditions spe- <br />cified in a proposed private crossing contract and a reement <br />dated September 13, 1954, being its Form 1521~ Local ~Revised <br />July 1952), upon the terms and conditions therein specified <br />and hereinafter referred to; and, <br />Whereas, it appears that the making and execution of <br />such contract and agreement on behalf of the City of Paris <br />is necessary, desirable and to the best interests of said <br />City; NOW, THEREFORE : <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: <br />That the City of Paris enter enter into a certain pri- <br />vate crossing contract and agreement as proposed by and be- <br />tween the St, Louis-San Francisco & Texas Railway Company, <br />dated September 13, 1954, granting unto the City of Paris the <br />right to construct and maintain a private road crossing upon <br />the following terms and conditions: <br />(1) Said private road crossing, 14 feet in width, <br />extending 120 feet in an easterly and westerly direction <br />over the right of way and main track of the railway of <br />said railroad company, the centerline of which is at mile <br />582.64 in the Redding Russell Headright, Lamar County, <br />Texas at a point 1372 feet northerly measured along the <br />centerline of said ma.in track at its intersection with <br />the centerline of public road crossing at Center Street. <br />(2) Said roadway 40 feet in width will connect with <br />the private road crossing described above, the centerline <br />of which roadway tnrill extend southerly parallel with and <br />70 feet perpendicularly distant in an easterly direction <br />from the centerline of the ma.in track aforesaid, a dis- <br />tance of approximately 245 feet to the southerly right of <br />way line of the railroad company. <br />(3) The City of Paris shall provide and maintain <br />necessary drainage and construct and maintain the cross- <br />ing, except between the rails. <br />(4) Said railray company shallconstruct and maintain <br />the crassing between the rails for which the City of Paris <br />shall pay to said railroad company in advance the sum of <br />Fifty (00.00) Dollars. <br />(5) All other terms and conditions specified in said <br />above mentioned form, contract and agreement shall be in <br />full force and effect and binding upon the City of Paris. <br />The T~Iayor of the City of Paris is hereby authori.zed and <br />directed to make and execute such written contract and agreement <br />on behalf of the City of Paris and said City is hereby bound and <br />obligated to all the terms and provisions thereof. <br />
