In consideration of the rental set out, and in strict <br />compliance wilLh the terms of this ordinance by Pete Hindrnan, the said <br />rete Hindman is 'rlereby au`horized to use the following desc-ribed space <br />*or a term of tpn ;10) years from the effective date or this oruinance <br />for the purpose of installing, erecting and mainiaining an illuminated <br />sign to advertise the business conducted ori the property and premises <br />abuctiny such streets, said space and property beiny described as follows, <br />to -wit: <br />A space 2 feet by 2 feet in Gimension, located 4~-0 feet <br />South of the South Line af Easi; Oak Street and _/,,Y feet <br />East of the East curb line of ivorth ;Nain Street. <br />Section 2. The franchise use herein granted shall be for a term <br />of ten (10) years, subject to the right of the City at; any time to al ter, <br />reform or amend it or to appropriate said space to the exclusive use of <br />the City of Faris in the event triat the same shall be needed or required <br />for any municipal purpose, afier giving thirty (30) days notice of such <br />need and intention to alter, reForm or amend the same and tendering to <br />saiG franchise holder refund of any unearned rentals paid in advance <br />pursuant to this ordinance. <br />5ection 3. Pete Hindnan shall pay an annual rentai of Five Dcllars <br />($5.00) for the term of ten (10) years, the first five annual rental pay- <br />ments to accrue and ae payable concurrent with the effective date cf this <br />ordinance and the last five annual payments to accrue five years from the <br />effective date of this ordinance. <br />Section 4. Any use of the space and privilege granted herein snall <br />be co:~clusive evidence of the acceptance by the said Pete Hindman of all <br />of the provisions of this ordinance, and all ether ordinances of ttie City <br />of Paris yoverning tne grantiny of franc'tiises, and shall expressly bind <br />the said Pete Hinaman, nis heirs anci assigns to pay the rental specified <br />and to i:eep the premises occuPlied by him in aood repair and safe condi- <br />ticn during the franciiise period, and also to indemnify t}ie City° of Paris <br />against any ana ali ciaims and actions for damayes to any person or pro- <br />perty growing out of or arising fxom the use of such premises under this <br />franchise, and the said Pete Hindman expressly agrees to deFend any and <br />all suits tnat may be instituted against the City cf Paris on account of <br />such mazntenance and use of such property, ana to pay all costs, attor- <br />neys' fees and o-ther expenses arising out of any sucn suit. <br />Sec-tion 5, ihe lease or franchise granted herein shall not be <br />assignable unless consent is given by the Governing Body of the City of <br />Paris in advance of sucn assiynment or transfer. <br />Section 6. railure to pay the rental provided herein when due <br />will authorize the Governing Body of the City of Paris at its option to <br />repeal cr revoke any rights granted under this ordinance, but such revo- <br />cation or repeal shall not release the francnise holder from any of the <br />obligations imoosed upon him by virtue of the provisions of Section 4 <br />hereof. <br />
