<br />Now theref'ore, in consideration of the premises and of the mtztual covenants
<br />and agreements of the parties nereto to be by tham reepectively kept and performed
<br />as hereinafter eet forth, it is agreed as follows:

<br />will prepa,re or providE for the plra.ris and epecifications, advertise fer bids, and
<br />let the construction contract, or otherwise provide for the construction, and will
<br />supervise the construction, reconstruction or bettermont work a,s required by said
<br />p1ans, and will pay thA cost of those items indicated on the p1.ans as to be pa,id
<br />for by the Sta,te,
<br />As long as the city etreet is a desigiated highway, the Sta,te will mainta.in
<br />said street project except those portions as m,,y be made the City's obliga.tion as
<br />mutually a,greed to by the parties hereto.
<br />The State will maintain sa,id street project or such portions thereof or
<br />extensions thereto as may be indicated on sa,id p1E+ns for State maintenance, a,n,d
<br />sucli other portione a,s may be mutua.lly agreed to by the partiee hereto.
<br />'I'he City, in consideration of tho mutual coveriants nerein contained, does
<br />hereby agrec to and doeg hereby authorize the State to improve or a.ssist in the
<br />improvement of sa.id street pro,ject at the location, to the grades and in the
<br />maruzer ahewn on the plans, which plans when approved by both pa..rties hereto wiL1
<br />be a.ttwched hereto, marked "Exhibit A" and berome a part hereof in all respecte.
<br />The City will proTide for sa.id street project a. rignt of w^.y frec of all
<br />obstructions and of a. width sufficient to properly provide for the improvements
<br />shown on the plans, without cost to the Stato and will not, in the future, pernv.t
<br />encroachments on stid right of way.
<br />The City will provi(ie a.t its own expense for the insta,llation, raising,
<br />lowering, removal or other necessary ad,juatment of any and all_utilities or
<br />services, whether publicly or privately owned, as may be necesgary to permit
<br />proper iinprovement, maintenance and use of said atreet project, ar?d, failuro of
<br />the City to promptly caxry out this provigion upon the written reque9t of the
<br />engineer shall, if such dela.y reoult3 in additiona,l erpense to the State, be the
<br />direct charge and oblioation o]" thc City.
<br />. Tne City a,gree3 to pay to the Sta.te pror.mptly the
<br />the su'agrade or surfacing made necesga,ry by rcaecn of
<br />Xemova,lor a3justment or an.y such publicly or privati
<br />rvices, which may occur after 'Uhe completion of the
<br />cogt of ma.king repairs to
<br />the instGllation, repair,
<br />:ly owned utilities or
<br />street project.
<br />The City agrees that it will refrain from passing an, ordinance fixing a
<br />speed limit on the a,bove mentibned street project of under twenty (20) milee pAr
<br />hour nor ti;ll it allow the erection of signe, aema.phores and/or si pnale that will
<br />give prefer.ence to loeal routes which intersect with the sa.id street project, ner
<br />that will slow up, hinder or delay traffic on eaid above mentianed atreet pro,ject.
<br />Th;; CiUy will at its own expenae ma.intain all etreet lights, traffic lights
<br />and 3i&-ia1 devices on said project, a.nd sweep, flueh and otherwiae keep said
<br />street pro,ject in a clean and sanitary conditinn.
