<br />SAME, A CERTAIN CONTRACT BETWEIIV THE CITY AND THE STATE OF TEXAs F'ROVIDING FdR TFE
<br />INSTALIATIOIV, .,CONSTRUCTION, MAINTENANCE, IIXI,STEPFCE AND USE OF THE SAID. STRELT
<br />PRQTECT; FOR THE INDENNTFICATION OF THE STATE OF TEKAS, BY THE CITY, AGAINST ALL
<br />DA,MAGES TO AUTOINING, ABUTTING AN'D QTHER PROF.ER7'Y, AND FOR EXPENSES IN CONNECTION
<br />W ITH A1VY CIA IM OR SUIT THEREOF ; AND DEC LAR ING AN EDEOGENCY AND PROV IDING THAT THlS
<br />ORDIlVANCE SHALL BE EFFECTNE FROM AND AFTER ITS PASSAGE.
<br />WHEREAS, the public convenience, eafety and neceesity of the city, and the

<br />be constructed. Sincd the exieting etree constitutee a danger and eeriouein-
<br />convenience to the public, it ie urgently required to be remedied; and
<br />WHEREA.S, the city has requeatdd the Statd of Texaa to contribute financisl-
<br />ly in the street project; and
<br />WREREAS, the Statd of Texas hae made it known to the city that it will
<br />assiet the city in the etrdet pro,ject by furni`shing the neceaeary funde for actual
<br />confstruction, reconstruction and maintenance; and by eupervieing construction, pro-
<br />viding the city approves the plane, gradee and alignment for eaid pro,ject; and
<br />WHERF..AS, the city, in coneideration of the providing of eaid porject,
<br />agrdes to indemnify the State of Tbxae againet all damagds or claime for damage to
<br />ad,joining, abutting or other property for which the State is liable, srieing out
<br />of, incident to, and in an,y way connected with the installation, the.... .construc-
<br />tion, the exietence, the uee and maintenance of tha street project or the pesasge
<br />and enforcement of this ordinance.
<br />NOW THEREFORE, BE IT ORDAINED $Y THE C ITY C OUNC IL SJ
<br />SECTION l. That eince the plzblic convenience, eafety and necesaity of the
<br />city an.d the people of the city require it, esid street ahall be _ conatructed.
<br />SECTION 2. That the State of Texas be ancl is hereby authorized to enter
<br />upon ._.__conatruct and maintain the street project at the location and in the manner
<br />shown on the plane, attached hereto and marked "Exhibit A" and made a part hereof
<br />in all reApecte.
<br />SECTION 3. That nothing in thia ordinance ahall be conetrued to obligate
<br />the State of Texae to Fay a ny direct, incidental, or coneequental damages to
<br />adjoining, abutting or other property in enforcement of thie ordinance or by
<br />reaeon of the inetallation, .__...conetruction, exiatence, uee and maintenance of
<br />the street project authorized herein.
