<br />A G R E E M E N T
<br />idow thereforc,, in conslder-ation cf the premiges and of the mutua,l covenantg
<br />and agreements of the parties hereto to be by thQm respectively kept and performed
<br />as hereinafter set forth, it is agreed as follows:
<br />The State, as its ccntribution to the improvement of said street project
<br />will prepare or provide for the plans a.nd specifications, advertise for bids, and
<br />let tho construction contract, or otherwise provide for the construction, and will
<br />supervise the con3truction, reconstruction or betterm.ent work as required by said
<br />p1assU, -.nd will pay the cost of thoee items indicated on the plans as to be paid
<br />for by the Bta,te.
<br />As long as the city street is a designated highwa.y, the Sta,te will maintain
<br />said street project except those portions ae may be made the City's obliga.tion as
<br />mutually agreed to by the parties hereto.
<br />The Sta.te will maintrzin sa.id street project or guch portions thereof or
<br />extensions thereto as ma.y bc indicated on sn.id plarx for State maintenan.ce, and
<br />euch other portions a.s m~."y be mutua.lly agreed to by the pa,rties hereto.
<br />The City, in conaiderati-on of the mutual covenunts herein contained, dooe
<br />hereby agrec to and doeg hereby autrorize the State to improve or assia'u in the
<br />improvement of said street pro,ject at the location, to the grades ^..n.d in the
<br />manner shcwn on the plans, whicAi plans when approved by both parties hereto wiLt
<br />be attwched hereto, marked "Exhibit A" and become a part hereof in all res.-pects.
<br />The City will provide for said gtreet project a right of way frec of al1
<br />obstructions and of a width sufficient to properly provide for the improvements
<br />3hown ori the plans, without cost to the State and will not, in the future, petnlit
<br />encroachments on stid right of way.
<br />The City will provide at its own expenae for the inata,llation, raising,
<br />lowering, removrl or other necessary ad,juetrnent of any an.d all ::utilities or
<br />services, whether publicly or priva.tely owned, as ma.y be neceseary to permit
<br />proper• irrprovement, maintenance and use of said street project, ar_d, failuro of
<br />the City to promptly carry out this providion unon the written request of the
<br />engineer shall, if such delay reuults in additional expense to the State, be the
<br />direct charge and obligation of the City.
<br />7he Cit,y agrees tc pay to the Sta,te pror.sPtly the cogt of making repair3 to
<br />the su'agrade or surfacing made necessary by reason of the instG.11^,tion, repair,
<br />removal, or adjustment or any such publicly or privately owned utilities or
<br />services, which may occur after the completion of the street project.
<br />The City agrees that it -vill refrain from passing an ordina.n.ce fixing a
<br />epeed li:mit on the above ine-ntioned street project of under twenty (20) miles por
<br />?zour nor tS:ll it a,llow the erection af signe, aemaphores and/or 3ignals tha,t will
<br />give prefer.er_ce to local routes which intersect with the said street proJect, zier
<br />th,at will slow up, hin.der or delay traffic on eaid above mantianed etreet project.
<br />The City will at its own expenee ma,intaa;n r3,11 street lights, traffic lig-hts
<br />and si&-ia.l devices on said project, and sweep, flush and otherwise keep said
<br />strcet project in a, clean and sanitary conditian.
