<br />Whereas, the State Highway Engineer, acting for and in behalf of the State Hign-
<br />way Coramission in activating such program, has made it lnown to the City -that the
<br />Sta.te wiJ.1 assiat the City in the imnrovement and./or maintenance of said street
<br />project by ~fusnishing the funde necessary to construct, reconstruct or otherwiee
<br />pl.aee said straet in a condition to properly se-rve motor vehicle traffic thereon by
<br />preparing plana for said irsprovemer:t and supervising the construction, reconstructicn
<br />or botterment worx as prcvided:in said plans or may be provi.ded in said plans cor_di-
<br />tionod that the City, as contexn.plated by Sanate Bill 415, Acts 46th Legislature,
<br />Regular Session, will enter into an agreement with the State for the pl,'xpose of
<br />deterrai.nirg the 1iabilities and responsibilities of the parties with referenca there-
<br />to, determining and providirg adequate and a,ppropriatE raeans for the regzlation of
<br />tr•affic, policing and maintenance of the project upon completion, ard, provid.ed
<br />furthar, tha+ the City approves the plans, specifications, alig_Ltnents and grades of
<br />the prcject; a,nd, provided f,irther, that the City wi11 in3ern.nify the State against
<br />a11 cl.amat,es to ad joininn, abutting or other proporty occasioned by or resulting from
<br />the installation, construction, existence, use or maintenar_ce of said atreet proj-
<br />ect and the passa,ge and enforcement of thp, ordinance herein referred to.
