RESOLUTION N0. 2130
<br />WHEREAS, the City Council of the City of Paris did
<br />hereto.fore in Resolution No. 1675 authorize the prepa-
<br />ration of construction plans under Infiltration-Inflow,
<br />Phase II, of the Sewerage Facility Plan and Environmental
<br />Assessment Project No. C-48-1248; and,
<br />WHEREAS, the City Council of the City of Paris has con-
<br />cluded that the best interest of the City of Paris will be
<br />served by the termination of said Infiltration-Inflow Project
<br />and any and all contracts entered into for the purpose of
<br />furthering said project due to the uncertainty of the avail-
<br />ability of federal funding for the construction phase of
<br />such project; and,
<br />WiEREAS, the cancellation of such project and contracts
<br />thereunder are hereby found to constitute an emergency, and
<br />the City Clerk of the City of Paris is directed to forthwith
<br />notify, in writing, the parties with whom the City of Faris
<br />has contracted in connection with t'rie Infiltration-Inflow
<br />Project, of the City's desire to terminate said agreements
<br />due to the uncertainty of the availability of federal funds
<br />for the construction phase of said project which the City
<br />Council finds to be good cause; NOia, THEREFOR.E,
<br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
<br />PARIS, That the Infiltration-Inflow Project No. C-48-1248
<br />will be cancelled on the 16th day of December, 1981; and,
<br />BE IT FURTHER RESOLVED, That all contracts authorized
<br />by Resolutions No. 1376, 1676, 1950, 1990 and 2095 with
<br />Hayter Engineering, Inc., are hereby cancelled; and,
<br />BE IT FURTHER RESOLVED, That the City Clerk give notice,
<br />in accordance with contract provisions, of the City's
<br />intention to terminate the agreements on the 16th day of
<br />December, 1981 by delivering such written notice by certified
<br />mail, return receipt requested, and the Director of Finance
<br />of the City of Paris, H. C. Greene, is hereby directed to
<br />make final payment, if any be justified under such contracts,
<br />no later than December 31, 1981; and,
<br />BE IT FURTHER RESOLVED, That said contractors be and
<br />they are hereby afforded an opportunity for consultation with
<br />the City Council of the City of Paris acting for the City of
<br />Paris, terminating party, at its regular Council Meeting on
<br />the 14th day of December, 1981, at 7:00 0'clock P.M,, in
<br />the Council Room, City Hall, Paris, Texas; and,
<br />BE IT FURTHER RESOLVED, That the necessity to conserve
<br />public funds being obligated under the terms of the existing
<br />contract authorized in connection with the Infiltration-Inflow
<br />Project require the declaration of an emergency and we so
<br />declare.
