1.2014 Investigalions involviilg consideration.of feasibility <br />studics, sites and ROW appraisals and valuations; de- <br />tailed quantity surveys of material and labor; material <br />audits or inventories required by the Owner. <br />1.2.15 Engineering scrvices usually eonsidered as a part of <br />I'L 92-500, Step 3"13i.dding and Construction Phase". <br />1.3 Yayment for Adclitioiial Services - In the event aiiy such <br />servl_ces are so requested by the Owner and performed by <br />the I,nginoer, the F;ngineer shall be compensated for his <br />cost as sct fortli ii1 I'art II.A.I, plus a service fee <br />equal to tlic ravcrage Lee under III.1.1. <br />Article 2. - Owner's l:osponsibility - The Owner shall in a timely <br />manuer: 2.1. Providc to the Engineer an apprcved Facility Plan. <br />2.2. <br />Dcsignate <br />in writing a <br />pers <br />on authorized to act as <br />the (hwner's representative. The Owner or his re- <br />preseniative sliall receive and examine documents <br />submittecl by tiic Engineer, interpret and define the <br />Owner's polici.es and render decisions and authoriz- <br />ations in writing, in ri timely rnanner to prevent delay in the <br />progress of the Engineer's services. <br />2.3. Pay directly for title opinions and insurance, re- <br />cording arid filing fees, site and ROW, field surveys <br />and acqui_sition cosL, permit fees, and related expenses. <br />2.4. Defend aild tiold tYiis Engineer harmless from thP untimely <br />or nou-perCoriuance, negligent acts, or omissions of <br />iNiinority I3usiness f:nterprise subcontractors <br />required to nueet EPA Region VI stated goals. <br />2.5. Provide fiscal, legal, accounting, and insurance <br />counseling services necessary for the project, legal <br />opinioils oE adequacy of existing KOW for project reuse <br />legal review of the Construction Contract Docunients, <br />and such auditing services as the Owner may require. <br />2.6. Assurc tlic necessazy lega.l actions, as required to pro- <br />vide full and free access for the Engineer to enter <br />upon all property required for the performance of the <br />Lngincer's scrvices under this Agreement. <br />2.7. Give prompt written notice to the Engineer whenever <br />tlie Owncr obse-rves or otlierwise becomes aware of any <br />changc in the Project Scope or other event which may <br />substcintially affect the Engineer's performances of <br />services under this Agreement. <br />2.8. Compensate the Engineer for services rendered under- <br />this Ag reement by the 20th of the month in which said services <br />are f i llcrl . <br />-10- <br />
