RESOLUTION N0. 1713 . <br />WHEREAS, the State of Texas and John C. Culpepper, Jr. as <br />owner of the Village Green Shopping Center, have agreed that <br />John C. Culpepper, Jr, as owner of the Village Green Shopping Center, <br />may construct a storm sewer within and a building across the Texas <br />Highway Departmert right of way and easement, upon the terms and <br />conditions and in the form of the agreement attached hereto as <br />Exhibit A; and, <br />WHEREAS, the City Council of the City of Paris is agreeable to <br />the conditions of such agreement and the covenants made by John C. <br />Culpepper, Jr, as owner of the Village Green Shopping Center, hold - <br />ing the Paris City Council and its duly appointed agents and employees <br />harmless against any action for personal injury or property damage <br />sustained by reason of the construction and/or maintenance of the <br />storm sewer and/or building within the limits of the right of way and <br />easement; NOW, THEREFORE, <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />PARIS, That James M. Brunette, Mayor of the City of Paris, be, and <br />he is hereby authorized and directed to execute on behalf of the City <br />of Paris the agreement between the State of Texas, City of Paris <br />and John C. Culpepper, Jr. as owner of the Village Green Shopping <br />Center, upon the terms and conditions and in the form attached <br />hereto as Exhibit A. <br />Passed and adopted this 13th day of October, 1975. <br />, <br />C11-I-)m <br />Ja M. runet Mayor <br />ATTEST: <br />H.
