RESOLUTION NO. 1401 <br />WHERFAS, the City of Paris, hereinafter called Public Body, <br />has heretofore under Title VII of the Housing Act of 1961, en- <br />tered into a Contract for Grant to Acquire and/or Develop Land <br />for Open-Space Purposes under which the Uni ted States of America, <br />herein&er called Government, agrees to make a Grant to the City <br />of Paris to aid in finaxicing the project, designated Tex. OSC-80; <br />and, <br />WHEREAS, the Government has made the additional require- <br />ment that the Public Body comply with the Land Acquisition <br />Requirements of Title III of the Uniform Relocation Assistance <br />and Real Property Acquisition Policies Act of 1970; and, <br />WHFREAS, said compliance is required to be in the form of <br />an amendment to Tex. OSC-80(G) Contract heretofore authorized to <br />be executed by the Mayor of the Public Body by Resolution No. <br />1398, dated January 11, 1971; and, <br />WHIIZEAS, it is necessary that the Mayor of the Public <br />Body be authorized to execute on behalf of the Public Body such <br />amendment to said contract; NOW, THER EFORE, <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, <br />AS FOLLOWS: <br />Section l. The City of Paris hereby assures that it has <br />authority under state law to comply with Section 305 o.f the Act <br />and agrees that, notwithstanding any provision set forth in <br />Tex. OSC-80(G): <br />(1) In acquiring real property in connection with <br />Tex. OSC-80 the Public Body will be guided to <br />the greatest extent practicable under state <br />law, by the land acquisition policies set out <br />under Section 301 of the Act and the provisians <br />of Section 302 thereof; <br />(2) Property owners will be paid or reimbursed for <br />necessary expenses as specified in Sections 303 <br />and 304 of the Act ; <br />(3) The costs to the Public Body of providing pay- <br />ments and assistance hereunder shall be borne <br />in accordance with Section 211 of the Act; and <br />(4) Public Body will execute such amendments to <br />Tex. OSC-80(G) and execute, furnish and be <br />bound by, such additional documents as the <br />Secretary of Housing and Urban Development <br />shall determine necessary to effectuate or <br />implement the assurances provided hereunder. <br />Section 2. The Mayor, B. M. Felty, is hereby authori2ed <br />and directed to execute an amendment to Contract Tex. OSC-80(G), <br />and the City Clerk is hereby authorized and directed to impress <br />the official seal of the Public Body and to attest the signa- <br />ture of the Mayor on such amendment. <br />
