RE.SOLUTION NO. 1397 <br />WHERFAS, it has been called to the attention of the City <br />Council of the City of Paris, that in the plat of Johnson's <br />Woods Subdivision Plat 3, as shown by said Plat, recorded in <br />Book 5, Page 43, Plat Records, Lamar County, Texas, that a <br />street designated Allen Street, which begins in the West <br />Boundary Line of 31st Street, S. E. and runs West to the West <br />Boundary Line of the Johnson's Woods Subdivision, a distance <br />of approximately 120.45 feet, being adjacent to the South <br />Boundary Line of Lot 11, Block A, and adjacent to the North <br />Boundary Line of Lot l, Block H, each of which are in said <br />Subdivision, was dedicated as shown in the Plat so filed; and, <br />WHFREAS, it has been called to the attention of the City <br />Council of the City of Paris that Allen Street, as shown on <br />said Plat, has never been used as a street and that provisions <br />were not made for a connection to said street at the West <br />Boundary Line of Johnson's Woods Subdivision, when the <br />Preliminary Plat of the 2nd Installment of Merry-Glen Addition <br />was approved by the City Council on January 8, 1968, without <br />requiring a continuation of Allen Street; and, <br />WHER EAS, the City of Paris, nor the citizens thereof, have <br />no need for said portion of Al1en Street as a public way and, <br />therefore, should not be burdened with the maintenance of the <br />same, but that an easement for drainage and utilities should be <br />retained by the City of Paris; NOW, THEREFORE, <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, <br />PARIS, TEXAS, That the Mayor of the City of Paris, B. M. Felty, <br />be, and he is hereby authorized to execute a quit claim deed <br />to the North 1/2 of Allen Street, from the West Boundary Line <br />of 31st Street, S. E. to the West Boundaxy Line of Johnson's <br />Woods Subdivision, to J. W. Harrison, the present owner of <br />Lot 11, Block A, Johnson's Woods Subdivision, and the South 1/2 <br />of Al1en Street, from the West Boundary Line of 31st Street, <br />S. E. to the West Boundary Line of Johnson's Woods Subdivision, <br />to J. W. Harrison, C. L. Walker, Mary Helen Harrison, Patricia <br />Slayton and Laura Ann Stokes, the present owners of Lot 1, <br />Block H, Johnson's Woocls Subdivision, and that an easement for <br />dxainage and utilities should be retained by the City of Paris <br />by having the Grantees of the quit claim deeds herein described <br />execute drainage and utility easements describing that portion <br />of Allen Street being closed which is needed for utilities and <br />drainage. <br />Passed and adopted this llth day of January, 1971. <br />~B. &_Felty, Mayor <br />ATTFST : <br />H.
