RFSOLUTION NO, 1371 <br />Wr3EREAS Title VII of the Housing Act of 1961, as amended, <br />provides for the making of grants by the Housing and Home <br />Finance Administrator to States and local public bodies to <br />assist them in the acquisition and development of permanent in- <br />terests in land for open-space uses where such assistance is <br />needed for carrying out a unified or officially coordinated <br />program for the provision and development of open-space land <br />as part of the comprehensively planned development of the <br />urban area; and, <br />WHEREAS, the City of Paris desires to participate in <br />such program and to fulfill all requirements necessary for <br />such participation; and, <br />WH EREAS, in order to participate in such program, the <br />City of Paris deems it necessary to formulate a land acquisi- <br />tion policy in accordance with the guide lines set out in <br />Department of Housing and Urban Development Letter No. OS-5 <br />of September 27, 1965, as follows: <br />l. Make every reasonable effort to acquire each <br />property by negotiated purchase before insti- <br />tuting eminent domain proceedings against the <br />property. <br />2. Not require any owner to surrender the right to <br />possession of his property until the Public Body <br />pays, or causes to be paid, to the owner (a) the <br />agreed purchase price arrived at by negotiation, <br />or (b) in any case where only the amount of the <br />payment to the owner is in dispute, not less <br />than 75 percerlt of the appraised fair value as <br />approved by the Public Body and concurred in by <br />HHFA. <br />3. Not require any person lawf'ully occupying pro- <br />perty to surrender possession without at least <br />90 days' written notice from the Public Body of <br />the date on which possession will be required. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF PARIS, That the City of Paris Land Acquisition <br />Policy, when participating in Title VII of the Housing Act of <br />1961, as amended, in developing permanent interests in land <br />for open-space uses a.s a part of tize comprehensively planned <br />development of the urban area, will be as follows: <br />l. Make every reasonable effort to acquire each <br />property by negotiated purchase before insti- <br />tuting eminent domain proceedings against the <br />property. <br />2. Not require any owner to surrender the right to <br />possession of his prolperty until the Public Body <br />pays, or causes to be paid, to the owner (a) the <br />agreed purchase price arrived at by negotiation, <br />or (b) in any case where only the amount of the <br />payment to the owner is in dispute, not less <br />than 75 percent of the appraised fair value as <br />approved by the Public Body and concurred in by <br />HHFA. <br />
