<br />Wf-iEREAS 2 R. H. Nelms is Lessee under a lease from the City
<br />of Paris on that portion of Culbertson Park, which is bounded on
<br />the North by Neathery Street, bounded on the East by 17th Street,
<br />S. E., bounded on the South by East Hearon Street, and bounded on
<br />the West by a fence running due North and South from Neathery
<br />Street to East Hearon Street, which fence is located on the West
<br />Side of the Miniature Golf Course now existing on the area in-
<br />volved, which lease terminates on October 31, 1970, and provides
<br />for a daily closing time of 10:00 o'cloclc P. M., which closing
<br />time the said R. H. Nelms requests to be extended to 11:00 o'clock
<br />P. M.; and,
<br />WHEREAS, R. H. Nelms requests the City of Paris for a three
<br />year lease covering the same property, beginning November 1, 1970
<br />through October 31$ 1973, in order that he may justify the erec-
<br />tion of certain improvements in the Miniature Golf Course opera-
<br />tion being cont3ucted; and,
<br />WHERFAS, the City Council of the City of Paris has for
<br />several years leased said property to R. H. Nelms and said lease
<br />arrangement has been satisfactory, and the citizens of the City
<br />of Paris and the public in general have been well served by the
<br />recreation facility in the form of the Miniature Golf Course, and
<br />it would be right and proper for the City of Paris to enter into
<br />an additional three year lease contract covering said property,
<br />with R. H. Nelms; NOW, THEREFORE,
<br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS,
<br />PARIS, TExAS, That the City Manager, C. L. Walker, be, and he is
<br />hereby authorized and directed to enter into an Amendment to
<br />Lease and Agreement, extending the hours of operation of R. H.
<br />Nelms from 10:00 o'clock P. M. to 11:00 o'clock P. M., which
<br />amendment would amend the Lease and Agreement entered into on the
<br />23rd day of October, 1967, by and between the City of Paris and
<br />R. H. Nelms; and?
<br />IT IS FURTHER RESOLVED that the City Manager of the City of
<br />Paris, C. L. Walker, be, and he is hereby authorized and directed
<br />to enter into a lease agreement on behalf of the City of Paris,
<br />Paris, Texas, a municipal corp oration, as Lessor, with R. H.
<br />Nelms, as Lessee, leasing for a period of three years, commencing
<br />November l, 1970 and ending October 31, 1973, a portion of
<br />Culbertson Park, which is bounded on the North by Neathery Street,
<br />bounded on the East by 17th Street, S. E., bounded on the South by
<br />Ea.st Hearon Street, and bounded on the West by a fence running due
<br />North and South from Neathery Street to East Hearon Street, which
<br />fence is located on the West Side of the Miniature Golf Course now
<br />existing on said property, which property is being used for the
<br />operation of a miniature golf course, and Lessee is to pay ten per
<br />cent (10%) of the gross receipts derived from said operation to
<br />the City of Paris as rent.
