By submitting a request for material on hand payment, the Contractor expressly authorizes the <br />Owner to audit the Contractor's material on hand records, and/or to perform process reviews of <br />the Contractor's record keeping system. In the event that the Owner determines the Contractor <br />to be in violation of any of the requirements of this provision, the Department reserves the right <br />to exclude payment for any and all materials on hand for the duration of the contract. The <br />Contractor shall be responsible for the retention of all records relating to material on hand <br />payment for a period of three (3) years after project completion. <br /> <br />From the total of the amounts so ascertained will be deducted five (5%) percent to be retained <br />until after the completion of the entire work to the satisfaction of the Owner, and the remaining <br />95 percent of the amount so ascertained will be paid to the Contractor less such amounts as may <br />be required by the contract to be deducted or as otherwise stated herein. <br /> <br />Partial estimates showing an amount of work performed since the last preceding estimate of less <br />that $1,000.00 may be withheld until the amount of work performed on a partial estimate is at <br />least $1,000.00 <br /> <br />The Contractor shall pay the subcontractor for work performed within ten days after the <br />Contractor receives payment for the work performed by the subcontractor. Also, any retained <br />monies on a subcontractor's work shall be paid to the subcontractor with ten days after <br />satisfactory completion of all the subcontractor's work. Completion of all the subcontractor's <br />work shall include test, maintenance and other similar periods that are the responsibility of the <br />subcontractor. <br /> <br />For the purpose for this Item, satisfactory completion shall have been accomplished when: <br /> <br /> (1) The subcontractor has fulfilled the contract requirements of both the Owner and the <br /> subcontract for the subcontracted work, including the submission of all submittals <br /> required by the specifications and the Owner and <br /> (2) The work done by the subcontractor has been inspected and approved by the Owner <br /> and the final quantities of the subcontractor's work have been determined and agreed <br /> upon. <br /> <br />The inspection and approval of a subcontractors work does not eliminate the Contractor's <br />responsibilities for all the work as defined in Item 7, Article 7.12. "Contractor's Responsibility <br />for Work". <br /> <br />The above requirements are also applicable to all sub-tier subcontractors and the above <br />provisions shall be made a part of all subcontract agreements. <br /> <br />Failure to comply with any of the above requirements may cause the Owner to withhold all <br />estimates which have or may become due and the Owner may suspend the work until his <br />requests are complied with. <br /> <br /> 2-2 009---062(M) <br /> 12-00 <br /> <br /> <br />
