RES OLU TION NO. 1029 WHEREAS, Bedford B. Harlan, on July S, 19S2, executed to the City of Paris, an out-fall sewer line easement on several tracts of land located North of the C ity of Pa ris ; and, WHEREAS, on October 27, 1951, Bedford B. Harlan had sold to S. E. Thompson and wife, O'.lie Thoxnpson, the following described property; All that certa.in tracts or parcels of land situated in Lamar County, Texas, part of the John Wilson Survey, an3 described as follows, to-wit: lst Tract: Abstract 981, being Lot 4 as described in partition of the estate of Jordan Randall, deceased, and shown of record in Book 144, Page 522, of the I?eed Records of Lamar County, Texas. Beoinning at the NE corner of Lot 3; Thence South 120 poles; Thence East 22, 4 poles a sta.ke; Thence North 120 poles; Thence West 22.4 po.les to the place of beginning, containing 16.8 acres more or less. 2:ad Tract: Being Lot No. 6 as descrabed in partition of the estate of Jordan Randall, decea.sed, as sh,own of record in Book 144, Page 522, Lamar County I?eed Records. Beginning at the NE corner of Lot Nu. 5; Thence South 120 poles a sta.ke; Thence East 5. 18 poles a sta,ke, the SE corner of said 90 a:.res; Thence North -with the EB line of said `90 acre tract, 120 poles; Thence West 6poles to the place of begi.nning, con}aining 4 acres, more or iess. The above two tracts being described as the 3rd and 4th Tracts respectively in the dead from Joe Thurxnon, 5ubstitute Trustee to Bed:=ord B. Harlan, dated February 24th, 1951, antl recorded in Vol. 317, Page 593 of the Deed Records of Lamar County, Texas; and, WHERE.AS, said sewer easement, which was zxecuted subsequent to the deed to Thampson, included the above described property; and, WHEREAS, the above described property was inserted in said easement by error and mis take; and, WHEREAS, noize of the above described two tracts is crossed by the out- fall sewer line, and the sa:me is located some dista.nce frorn the out-fall sewer line ; and, WHEREAS, the City of Paris has no future intentions of crossing the above two described tracts; and, WHEREAS, tha easement from Bedford B. Harlan creates a-cloud upon the title of S. E. Thompson and wife, Ollie Thoxnpson; NUN, THER.EFORE, BE TT RESOLVEI? BY THE GITY C OUNGIL OF THE CITY OF PAR T".~, TEXAS, That the City Manager, H. C. Kennemer, be, and he is hereby authorizetl to execute ta S. E. Thompson and wife; Ollie Thompson, a quit- claim deed, in order to remove the cloud from the title of S. E. Thompson and wife, Qllie Thompson.
