• • <br />RESOLUTION NU'. _7Q2~~• <br />WHEREAS, The Paris Junior College School District of the City of Paris <br />has requested the use of the old abandoned wells and pools belonging to the City <br />of Paris, located cn East about CollegeaSchool District <br />of the City Llmlts and <br />properties; and, <br />WHEREr1S, The City of Paris is not using said wells, pools, or v+rater for <br />any purpose whatsoever; and, <br />WHEREaS, The City of Paris has long ago abandoned same as part of its <br />Water Supply System; and, <br />WHEREAS, Titheo use aofSSahas id we111orrwellsdbynthetParisdJuthe nic>reCollege <br />that may be derived from <br />School District; NGti'd, THEREFORE, <br />BE IT RESOLVED BY THE CITY MUNCIL OF THE CITY OF PARIS, That -the City <br />of Paris enter into an agreement with the Paris Junior College School District <br />leasing for a period of one (1) year the 14 acres and wells and pools tllereon <br />at an agreed and stipulated figure of $1.00 per year, and which lease may be <br />terminated at any time upon its renewal date by giving sixty days (60) w,ritten <br />notice on the part of the City of Paris to the Paris Junior College School <br />District. That any renewals of said lease after the expiration of the one year <br />term aforesaid shall be from year to year. That said lease provide that under <br />no circumstances or condition shall the Paris Junior College School District take <br />water from said property to be sold to any person under any condition or to be <br />distributed off the actual premises owned or under lease thrJUrr pur- <br />College School District and adjoining such City property, and then onlY fo <br />poses of irrigation. That said lease shall provide, that if at any time the <br />Paris Junior College School District shall use the water from said wells whatso- <br />ever, except for the purposes of irrigation of its projects on lands owned by it <br />or leased by it and adjoining the aforesaid 14 acres, then the lease bet.ween the <br />City of Paris and Paris Junior College School District may be cancelled upon ten <br />(10) days written notice to the Paris Junior College School District. T'hat said <br />lease shall further provide that the lessee will assume all liability far any <br />accidents, injuries, or damages that might occur on said premises or in the <br />operation of said project. That the lessee will assume all liability for the <br />protection of the wells and pools and the various properties in co.nnecti.on with <br />such operations and shall in all instances hold the City of ParisThatetheoParis <br />liability for accidents, injuries, or damages on such premises. <br />Junior College School District, at its option, shall have the right to i-emove <br />any of the ~~~~*x= underbrush now on said premises, but that lessee <br />shall not be required to do so unless it so desires. That the lease fu:cther <br />provide that the lessee shall place no permanent buildings or structures upon <br />said premises during the term of the lease.
