• 0 <br />RESOLUTION N0. _J/ 3 • <br />; WHEREAS, J. H. Wages, James Castleman and Don Bryant, propose to <br />build, erect and construct on available space private airplane hangers at <br />Cox Airfield under contract, agreement and lease with theCity of Paris, each <br />to be built by said respective persons at an estimated cost of $1,200.00; and, <br />WHEREAS, it is to the best interests of the City of Paris that the <br />use and development of the facilities of Cox Field by private flyers be <br />encouraged by every reasonable means, and particularly, it is to the best <br />'':interest of the City of Faris that said proposal of said respective parties <br />be accepted and approved and that the lease of a portion of said Cox Field <br />'and the fscilities thereof be leased to said persons: <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />PARIS: That the City of Paris enter into a written contract, agreement and <br />lease with the said J. H. Wages, James Castleman and Don Bryant, authorizing <br />such respective persons to build and erect at and on available space at Cox ; <br />!'Air#ield a private air plane hanger, subject to the following terms and <br />provisions, to-wit: <br />(1) That such respective air plane hangers shall imediately upon <br />;';construction become the property of the City of Paris, and such respective <br />`-builders shall have the exclusive use and occupancy of the same for a period <br />of 6ee(*0) years from and after the date of this resolution; provided tYat <br />if such lease is terminated under the terms and provisions of the deed by <br />which the Gity of Paris has possession and control of Cox Field, and if as <br />~ a result of such termination the City of Paris is paid or compensatbd for any <br />+ such hanger, the balance of any such paymentg after deducting therefrom a rental` <br />i;at the rate of $15.00 per month shall be paid to such builder. <br />(2) Each of said respective persons building such air planee <br />'f;hangers shall, at their sole cost and exptrese, keep such hangers in good : <br />`repair and safe condition. <br />(3) The City of Paris shall be held blameless for any damages or ~ <br />loss incurred by it, if any, by reason of the use of any such hanger and the <br />,said premises, and such proposed lessees must agree in writing to indemnify <br />and hold harmless said city against each and every claim, demand or cause of <br />; action that may be made against it by reson or arising out of any act or omission <br />? of such respective persons. <br />: <br />The *ayor of the City of Paris is hereby authorized and diregted to z <br />sign on behalf of the City of Paris a written contract, agreement and lease, <br />binding and o§ligating the City of Paris to the terms and provisions of such <br />'proposed leases and agreements for the period of 10 years from this date f <br />i in accordance with the provisions of this resolution. <br />PASSED AND ADOPTED this 25thgday of Mayt 1953. <br />. <br />A <br />ATTEST: fr~ CitY Clerk.
