Nix, owner of the property and preMises located at and designated as 'No. 523 CJest Sherman Street, being a lot located on the south side of said ',+est Sizerman Street in the 500 31oc;< thereoi, has Taade arplica- tion to the City of Paris for a building permit authorizinj the enlargernent and extension of the 6uilding on such premises vrhich he presently occupies as a residence and in vvhich he operates a s;,iall r,rocery store, such addition or extension to be added to such building being approxi;aately feet in width by fV-11` :eet in depth; and, ~+hereas, it appears that such property and premises is presently lo- cated in a"Residential District", as defined by the 7_oning Ordinance of the City of Paris, so that a prior and existing and present use of such property and premises for the operation of a retail grocery store constitutes a"non- conforming use" thereof within the neanin,r, of said "Loning ordinance; and, 'V±hereas, as required by the provisions ef sach ordinance, the building official of the City of Paris has refused to approve such apnlication :or building perniit because the granting thereof rvould constitute an authorization for an extension of non-conforming use in a residential area; and, ~lhereas the said A. Nix has appealed to the City Council frora such action and decision of tne building official; and, i'Jhereas, it appears to the Cc,uncil that pualic nctice of a hearing on such appeal beiore the Council at this tirne and place has been duly given, and it further appearing to the Council that such appeal involves an extension of a non-conforming use, and that the granting and approval of such application for building perrnit of the said bJ.
