If any pan of CONTRACTOR's Work depends for <br />proper execution or results upon thc work of any such other <br />contractor or utility owner (or OWNER), CONTRACTOR <br />shall inspect and promptly report to ENGINEER in writing <br />any delays, defects or deficiencies in such work that render <br />it unavailable or unsuitable for such proper execution and <br />results. CONTRACTOR's failure so to report win constitute <br />an acceptance of the other ~vork as fit and proper for integra- <br />tion with CONTRACTOR's Work except for latent or non- <br />apparent defects and deficiencies in the other work. <br /> <br />lures which have been utilized by ENGINEER in preparing <br />thc Dcawings and Specifications. <br /> <br /> 8.5. Paragraph 15.2 <br />deals with OWNER's right to terminate services of CON- <br />TRACTOR under certain circumstances. <br /> <br />ARTICLE ~ENGINEER'S STATUS DURING <br /> CONSTRUCTION <br /> <br />Coordination: <br /> <br /> 7.4. If OWNER contracts with others for the perfor- <br />mance of other work on the Project at the site, the person or <br />organization who will have authority and responsibility for <br />coordination of the activities among the various prime con- <br />tractors will be identified in the Supplementary Conditions, <br />and the specific matters to be covered by such authority and <br />responsibility will be itemized, and the extent of such author- <br />ity and responsibilities will be provided, in the Supplementary <br />Conditions. Unless othenvise provided in the Supplementary <br />Conditions. neither OWNER nor ENG[NEER shall have any <br />authority or responsibility in respect of such coordination. <br /> <br />ARTICLE g--OWNER'S RESPONSIBILITIES <br /> <br />8.1. OWNER shall issue all communications to CON- <br />TRACTOR through ENGINEER. <br /> <br /> 8.2. In ca~e of tcrmlnadon of the employment of ENGI- <br />NEER, OWNER shall appoint an engineer against whom <br />CONTRACTOR makes no reasonable objection, whose sta- <br />tus under the Contract Documents shall be that of the former <br />ENGINEER. Any dispute in connection with such appoint- <br />ment shall be subject to arbitration. <br /> <br /> 8.3. OWNER shall famish the data reqolred of OWNER <br />under the Contract Documents promptly and shall make pay- <br />ments to CONTRACTOR promptly alter they are due as <br />provided in paragraphs 14.4 and 14.1~. <br /> <br /> 8.4. OWNER's duties in respect of providing lands and <br />easements and providing coglncerlng surveys to establish <br />reference points are set forth in paragraphs 4.1 and 4.4. Para- <br />graph 4.2 refers to OWNER's identifying and making avail- <br />able to CONTRACTOR copies of reports ofcxploratlons and <br />tests of subsurface conditions at thc slte and in existing stroc- <br /> <br />Owner's Representative: <br /> 9.1. ENGINEER will be OWNER's representative dur- <br />ing the construction period. The duties and responsibilities <br />and thc limitations of authority of ENGINEERas OWNER's <br />representative during construction are set forth in the Con- <br />tract Documents and shall not be extended without written <br />consent of OWNER and ENGINEER. <br /> <br />Vixlt$ to Site: <br /> <br /> 9.2. ENGINEER will make visits to the site at intervals <br />appropriate to the various stages of construction to obser,,e <br />the progress and quality of the executed Work and to.deter- <br />mine, in general, if the Work is proceeding in accordance <br />.with the Contract Decuments. ENGINEERwilt not be required <br />to make exhaustive or continuous on-site inspections to check <br />the quality or quantity of the Work. ENGINEER's efforts <br />will b¢ directed toward providing for OWNER a greater degree <br />of confidence that thc completed Work will conform to thc <br />Contract Documents. On thc basis of such visits and on-slte <br />observations as an experienced and qualified design profes- <br />slonal, ENGINEER will keep owlqER informed of the prog- <br />ress of the Work and will endeavor to guard OWN ER against <br />defects and deficiencies in the Work. <br /> <br /> Project Representation: <br />* 9.3. It' OWNER and ENGINEER agree, ENGINEER <br />will furnish a Resident Proje'~t Representative to assist <br />ENGINEER in observing the performance of the Work. The <br />duties, r~pon$ibil[ties and [imitations of authority of any <br />such Resident Project Representative and assistants will be <br />as provided in the Supplementary Conditions. If OWNER <br />designates another agent to represent OWNER at the site <br />who is not ENGINEER's agent or employee, the duties, <br />rcsponsibil[tles and limitations of authority of such other <br />per~on wdl be as prov'dcd in thc Supplementary Conditions. <br /> <br />*See Supplementary Conditions 47 <br /> <br /> <br />
