DRAFT <br /> <br />LISAkRESOLUTIONS\CURRENT\EMS Equipment Purchase 01 <br /> November 8, 2001 <br /> <br />RESOLUTION NO. <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, <br />PARIS, TEXAS, AUTHORIZING THE EXECUTION OF A PURCHASE <br />ORDER FOR FIVE (5) UPGRADES FOR THE END TIDAL CARBON <br />DIOXIDE MONITORS IN USE BY THE EMERGENCY MEDICAL <br />SERVICES DEPARTMENT; MAKING OTHER FINDINGS AND <br />PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN <br />EFFECTIVE DATE. <br /> <br /> WHEREAS, the Emergency Medical Services Department of the City of Paris is in need of <br />purchasing upgrades for its end tidal carbon dioxide monitors; and, <br /> <br /> WHEREAS, Section 252.022(a)(7)(A) of the Local Government Code exempts from the <br />requirement for competitive bidding a procurement of"items that are available from only one source <br />because of patents, copyrights, secret processes, or natural monopolies"; and, <br /> <br /> WHEREAS, Medtronics Physio-Control Corp. is the sole source provider of Physio-Control <br />brand products, and, since the EMS currently utilizes other Physio-Control brand equipment, <br />components, and peripherals which are proprietary, with no other brands being compatible therewith, <br />it is deemed appropriate that the EMS purchase such equipment from Medtronics Physio-Control <br />Corp. without the requirement for competitive bidding; and, <br /> <br /> WHEREAS, it is further deemed appropriate that the City Manager be authorized to execute <br />a purchase order for said upgrades for a total purchase price of $21,372.50; NOW, THEREFORE, <br /> <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, <br />TEXAS: <br /> <br /> Section 1. That the findings set out in the preamble to this resolution are hereby in all things <br />approved. <br /> <br /> Section 2. That the City Manager be, and he is hereby, authorized and directed to execute, <br />on behalf of the City of Paris, a purchase order for five (5) upgrades to the end tidal carbon dioxide <br />monitors in use by the Emergency Medical Services Department from Medtronics Physio-Control <br />Corp., which is the sole source provider of such equipment, for a total purchase price of $21,372.50. <br /> <br />Section 3. That this resolution shall be effective from and after its date of passage. <br /> <br /> <br />
