Hammons" sign as a Historic Sign located in the Downtown <br />Historic District. <br />POLICY ISSUE�S�: <br />Council objective; nomination of certain Historic Sign <br />BACKGROUND: <br />Dr. Terry L. Kilgore sent a letter on August 17, 2012, requesting the sign located at 25 Lamar Avenue <br />be considered and nominated as a historical sign. On September 12, 2012, the Historic Preservation <br />Commission nominated the sign located at 25 Lamar Avenue, being the L.O. Hammons as a historical <br />sign and be protected from forced removal. The nomination was subject to the sign being repaired. <br />The sign ordinance, Ordinance 2008-021, Section 28-9(d) Historically significant signs states; The <br />historic preservation commission, the committee charged with protecting historical districts, may <br />nominate signs located in such districts as historically significant signs. The city council shall hold a <br />public hearing and make final determination as to the historical significance of such nominated sign, <br />and if such sign is found to be historically significant then the prohibition herein shall not regulate such <br />sign. However, such sign may only be maintained and shall not be enlarged, diminished, or <br />significantly changed, and in the event of such notification of change, it shall lose the protection as a <br />historically significant sign. <br />According to Sign Ordinance 2008-021, Section 28-21(b) (1) Abandoned or obsolete signs. Any sign <br />now or here after existing which no longer advertises a bona fide business conducted or a product sold <br />at said premises, shall be removed by the owner, agent, or person having the beneficial use of the <br />building or structure upon which the sign may be found or associated within twelve(12) months after the <br />said business has been closed; provided, however, if the premises containing the sign is leased, such <br />sign shall be removed within twenry four (24) months after the most recent tenant ceases to operate on <br />the premises. <br />By nominating this sign the City Council will protect it from removal, enabling this important piece of <br />history to remain and be preserved. If the City Council chooses not to nominate the sign the property <br />owner will be required to remove the sign by ordinance. <br />BOARD�COMMISSION RECOMMENDATION: <br />The Historic Preservation Commission has nominated the previous listed sign as historic sign, subject to <br />the sign being repaired.
