AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, AMENDING ZONING ORDINANCE N0. 1710 OF THE CITY OF PARIS, TEXAS, ESTABLISHING A HISTORIC OVERLAY DISTRICT (HD), ON LOT 20, BLOCK 131 BEING 726 WEST SHERMAN STREET, IN THE CITY OF PARIS, LAMAR COUNTY, TEXAS IN ACCORDANCE WITH THE RECOMMENDATIONS OF THE PLANNING AND ZONING COMMISSION AND THE HISTORIC PRESERVATION COMMISSION; PRESERVING THE EXISTING USE AND ZONING DESIGNATIONS OF THE PROPERTY SO DESIGNATED; DESIGNATING THE BOUNDARIES OF THE HISTORIC OVERLAY (HD) SO ESTABLISHED; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Paris, Texas, has received a request from the Paris Historic Preservation Commission, following notice to the owner and a public hearing thereon, for an amendment to the zoning ordinance of the City of Paris to establish a Historic Overlay District (HD) on Lot 20, Block 131, being 726 West Sherman Street in the City of Paris, Texas; and, WHEREAS, on September 24, 2012 the Historic Preservation Commission reviewed and recommended that the Historic Overlay District on this property be approved in accordance with the City zoning ordinance and State law; and, WHEREAS, on October 1, 2012, and, the Planning and Zoning Commission did conduct a public hearing on said proposed amendment to the City zoning ordinance and, following said hearing, made formal recommendation to the City Council regarding said proposed Historic Overlay District; and, WHEREAS, on October 22, 2012 the City Council of the City of Paris did subsequently conduct a public hearing on the aforesaid proposed amendment to the City zoning ardinance, and having considered the recommendations of the Planning and Zoning Commission and the testimony and evidence introduced at said public hearing, found and determined that the house located on the property is almost 100 years old and represents a historical architectural style from that period and that a historic overlay district would be appropriate for the property. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2.
