i� <br />ORDINANCE NO. <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, <br />AMENDING ZONING ORDINANCE N0. 1710 OF THE CITY OF PARIS, <br />TEXAS, ESTABLISHING A HISTORIC OVERLAY DISTRICT (HD), ON LOT <br />20, BLOCK 131 BEING 726 WEST SHERMAN STREET, IN THE CITY OF <br />PARIS, LAMAR COUNTY, TEXAS IN ACCORDANCE WITH THE <br />RECOMMENDATIONS OF THE PLANNING AND ZONING COMMISSION <br />AND THE HISTORIC PRESERVATION COMMISSION; PRESERVING THE <br />EXISTING USE AND ZONING DESIGNATIONS OF THE PROPERTY SO <br />DESIGNATED; DESIGNATING THE BOUNDARIES OF THE HISTORIC <br />OVERLAY (HD) SO ESTABLISHED; MAKING OTHER FINDINGS AND <br />PROVISIONS RELATED TO THE SUBJECT; PROVIDING A REPEALER <br />CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY <br />CLAUSE; AND DECLARING AN EFFECTIVE DATE. <br />WHEREAS, the City Council of the City of Paris, Texas, has received a request from the <br />Paris Historic Preservation Commission, following notice to the owner and a public hearing <br />thereon, for an amendment to the zoning ordinance of the City of Paris to establish a Historic <br />Overlay District (HD) on Lot 20, Block 131, being 726 West Sherman Street in the City of Paris, <br />Texas; and, <br />WHEREAS, on September 24, 2012 the Historic Preservation Commission reviewed and <br />recommended that the Historic Overlay District on this property be approved in accordance with <br />the City zoning ordinance and State law; and, <br />WHEREAS, on October 1, 2012, and, the Planning and Zoning Commission did conduct <br />a public hearing on said proposed amendment to the City zoning ordinance and, following said <br />hearing, made formal recommendation to the City Council regarding said proposed Historic <br />Overlay District; and, <br />WHEREAS, on October 22, 2012 the City Council of the City of Paris did subsequently <br />conduct a public hearing on the aforesaid proposed amendment to the City zoning ardinance, and <br />having considered the recommendations of the Planning and Zoning Commission and the <br />testimony and evidence introduced at said public hearing, found and determined that the house <br />located on the property is almost 100 years old and represents a historical architectural style from <br />that period and that a historic overlay district would be appropriate for the property. <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE <br />CITY OF PARIS, TEXAS: <br />Section 1. That the findings set out in the preamble to this ordinance are hereby in all <br />things approved. <br />Section 2.
