McCall, Parkhurst & Horton L.L.P. <br />MEMORANDUM <br />TO: Interested Parties <br />FROM: McCall, Pazkhurst & Horton L.L.P. <br />DATE: June 18, 2001 -REVISED: REVISIONSlNITALICS <br />SUBJECT: Legal Election Dates and State Holidays in 2001 and 2002 <br />Change of Uniform Dates and Restriction to Uniform Dates <br />As of September l, 2001, all bond elections in Texas must be held on uniform election dates (as <br />changed on September 1, 2001), with the exception of bond or maintenance tax elections for school <br />districts and colleges, which entities may additionally hold a"wild-card" elecrion on any date once <br />duiiiig each biennium. Note that school or college elections called prior to 9/1/01 for dates on or <br />after 9/1/01 may still be held under prior law without using up the one "wild cazd" election date. The <br />remaining uniform election dates for 2001-2002 are now as follows: <br />• August ll, 2001 <br />• September 8, 2001 <br />• November 6, 2001 <br />• Febmary 2, 2002 <br />• May 4, 2002 <br />• September 14, 2002 <br />• November 5, 2002 <br />(final uniforrn date under prior law) <br />(2nd Saturday in September); <br />(1 st Tuesday after 1 st Monday in November); <br />(lst Saturday in Febnuary); <br />(lst Saturday in May); <br />(2nd Saturday in September); and <br />(1 st Tuesday after the first Monday in November); <br />"Wild-card" elections by school dishicts and colleges may be held on any date except for the blackout <br />dates 30 days before and after the state general elections. Since no state general elections aze held in <br />2001, there are no blackout dates in 2001. The state general elections in the 2002 are as follows: <br />prilnary: <br />March 12, 2002 <br />(second Tuesday in March); <br />Runoff: <br />Apri19, 2002 <br />(second Tuesday in April); and <br />Genernl: <br />November 5, 2002 <br />(first Tuesday after first Monday in November). <br />A graphical representation of the legal dates and blackout dates is attached to this Memorandum. <br />Timeof Calling Election <br />On June 17, 2001, Governor Rick Perry vetoed the bill that would have required all elections to be <br />called at least 62 days prior to the election date. Therefare, the minimum remains at 45 days. <br />
