City Council Minutes <br />September 13, 2000 <br />Page 5 <br />stating that in 1959 the citizens voted to continue the Paris Band and allow the <br />Band.003 of every one hundred dollars of valuation, and up until 1986 the tax <br />rate was considered the General Fund, the Interest and Sinking Fund and the <br />Band. Mr. Steeley said in 1986 that was dropped without an election to <br />determine if the citizens wanted to keep the Band as part of the tax rate, or part <br />of the budget. Mr. Steeley said he was curious to know why that happened. <br />Gene Anderson, Director of Finance, came forward stating that as far as he <br />knows, there are no requirements too segregate monies in a separate fund for <br />the Paris Band. Mr. Anderson said when he came to work for the City of Paris <br />in 1985 it was already incorporated in the General Operating Fund. Mr. <br />Anderson said that within the tax ordinance each year is a separate tax item <br />showing how much of the General Fund rate is allocated or needed to fund the <br />Paris Band. Mr. Anderson said the number is still there but it is being <br />incorporated in the General Fund. <br />Mr. Steeley said could not see how the Band can be taken out of the taxes and <br />put it in the budget without having a vote by the citizens. Mr. Steeley <br />explained that the reason they had the vote in 1959 was so that they could nail <br />it down. Mr. Steeley said that the.003 would generate $30,000.00 for the Band <br />at this time, but every year the budget has been way below what the .003 <br />would generate. <br />City Attorney Schenk said he has reviewed the election documents and looked <br />at state statutes and you have to put that in the context of the time frame in <br />which Municipal Bands are created. He said that the earlier statute goes back <br />many years, and that qualified the ability of cities to have Municipal Bands, <br />including home rule cities. City Attorney Schenk said this is not to do away <br />with the Municipal Band, and he felt that was the proposition that was <br />approved for the Municipal Band was that an entity that would be created and <br />would be continue in terms of funding by the city, but the proposition was <br />whether or not the city, as you said, could fund it up to 3 mils or may fund it <br />with General Revenue Funds, and it to the amount it may be funded with.
