Government Code - CHAPTER 2303 Page 14 of 28 <br />Subsection (a), the governing body shall notify the association of the specific reasons for the decision <br />and shall allow the association to amend the application on or before the 60th day after the date of the <br />notification. <br />(d) The association shall furnish to the governing body of the enterprise zone: <br />(1) an annual statement of the programmatic and financial status of each approved project; and <br />(2) an audited financial statement of the proj ect. <br />Added by Acts 1993, 73rd Leg., ch. 268, § 1, eff. Sept. 1, 1993. <br />SUBCHAPTER F. QUALIFIED BUSINESSES AND ENTERPRISE PROJECTS <br />§ 2303.401. Definitions <br />In this subchapter: <br />(1) "New permanent job" means a new employment position created by a qualified business as <br />described by Section 2303.402 that: <br />(A) has provided at least 1,820 hours of employment a year to a qualified employee; and <br />(B) is intended to exist during the period that the qualified business is designated as an enterprise <br />project under Section 2303.406. <br />(2) "Retained job" means a job that existed with a qualified business before designation as an <br />enterprise project that: <br />(A) has provided employment to a qualified employee of at least 1,820 hours annually; and <br />(B) is intended to be an employment position during the period the business is designated as an <br />enterprise project in accordance with Chapter 151, Tax Code. <br />Added by Acts 1993, 73rd Leg., ch. 268, § 1, eff. Qualified Business <br />(a) A person is a qualified business if the department, for the purpose of state benefits under this <br />chapter, or the governing body of an enterprise zone, for the purpose of local benefits, certifies that: <br />(1) the person is engaged in or has provided substantial commitment to initiate the active conduct of a <br />trade or business in the enterprise zone; and <br />(2) at least 25 percent of the person's new employees in the enterprise zone are: <br />(A) residents of any enterprise zone in the jurisdiction of the governing body of the enterprise zone; <br />or <br />://www.capitol.state.tx.us/statutes/go/go230300.html 1/12/2002 <br />
