Draft <br />RESOLUTION <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, <br />TEXAS AUTHORIZING APPROVING AN APPLICATION TO THE <br />TEXAS DEPARTMENT OF TRANSPORTATION FOR A STATEWIDE <br />TRANSPORTATION ENHANCEMENT PROGRAM FOR FUNDING OF <br />A 2.36 MILE ADDITION TO THE TRAIL DE PARIS FROM <br />HERITAGE PARK TO THE RED RIVER VALLEY FAIRGROUNDS; <br />MAHING OTHER FINDINGS AND PROVISIONS RELATED TO THE <br />SUBJECT AND DECLARING AN EFFECTIVE DATE. <br />WHEREAS, The Texas Department of Transportation issued a call for project <br />nominations in September 2012 for communities to apply for federal highway funding <br />assistance made available through the Transportation Enhancement Program; and, <br />WHEREAS, a 236 mile addition to the existing Trail de Paris from Heritage <br />Park to the Red River Valley Fairgrounds in the City of Paris will provide improved <br />access and safety for bicyclist and pedestrians to join neighborhoods, schools, parks, <br />fairgrounds and the local boys & girls club further depicted in the aerial map attached <br />hereto as Exhibit "A"; and, <br />WHEREAS, the City proposes repealing Resolution 2012-089 because of <br />changes in construction estimates and hereby submits a revised nomination requesting <br />federal funding for assistance in the amount of $696,207.00; and <br />WHEREAS, the program requires a minimum 20% local funding match from <br />the City of Paris which in this case is calculated to be approximately $181,014.00 plus <br />100% of any overruns above the total project estimate of $696,207.00. The City of <br />Paris supports funding this project as shown in the nomination budget <br />(including the minimum 20% local match) and commits to the project's <br />development, implementation, construction, maintenance, management and <br />financing. The City is willing and able to enter into an agreement with TxDOT <br />by resolution or ordinance should the project receive funding; and, <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF PARIS, TEXAS: <br />SECTION 1. That the City Council hereby repeals Resolution 2012-089 adopted <br />October 12, 2012 and adopts Resolution approving the submission of <br />the project nomination; and the support and funding of the project should it receive federal <br />funds. <br />SECTION 2. The City of Paris supports funding this project as shown in the <br />project nomination budget and commits to the project's development, implementation, <br />construction, maintenance, management, and financing (including the local matching <br />
