DRAFT <br />J:WttorneyW.ICE~SWO~CURRENT~ranklin Donation Res.wptl <br />March 8, 2002 <br />RESOLUTION NO. <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, <br />PARIS, TEXAS, ACCEPTING A DEED OF DONATION OF PROPERTY <br />FROM ERA MAE FRANKLIN, BEING LOT 20, CITY BLOCK 197, <br />LOCATED AT 1728 MAPLE AVENUE; MAHING OTHER FINDINGS AND <br />PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN <br />EFFECTIVE DATE. <br />WHEREAS, the City of Paris is in receipt of an offer of donation of property from Era Mae <br />Franklin as owner of Lot 20, City Block 197, located at 1728 Maple Avenue; and, <br />WHEREAS, the aforesaid owner of this vacant lot states she is no longer able to care for this <br />property; and, <br />WHEREAS, in lieu of the City mowing and clearing said lot and placing a lien on the <br />property, thereafter to initiate collection proceedings on the property for the lien cost, the property <br />owner has offered to convey the aforesaid vacant lot to the City tax free, under a General Warranty <br />Deed, with the City to thereafter mow and clean the lot and utilize the property thereafter as the City <br />would deem appropriate; and, <br />WHEREAS, the City Council finds and determines that it would be in the best interests of <br />the City ofParis to accept the offer of donation of the aforesaid property, to mow and clean the vacant <br />lot, and to thereafter utilize the aforesaid property as the City Council deems appropriate; NOW, <br />THEREFORE, <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, <br />TEXAS: <br />Section 1. That the findings set out in the preamble to this resolution are hereby in all things <br />approved. <br />Section 2. That the donation of Era Mae Franklin of Lot 20, City Block 197, located at 1728 <br />Maple Avenue, Paris, Texas, by General Warranty Deed in such form as is acceptable to the City <br />Attorney, be, and the same is hereby, in all things accepted. <br />Section 3. That this resolution shall be effective from and after its date of passage. <br />PASSED AND APPROVED this l lth day of March, 2002. <br />Michael J. Pfiester, Mayor <br />ATTEST: <br />Thomas E.
