Item Nos. 15-17 <br />memo�andum <br />TO: City Council <br />John Godwin, City Manager <br />FROM: Alan Efrussy, AICP, Planning Manager <br />SUBJECT: ZONING PUBLIC HEARINGS <br />DATE: February 5, 2013 <br />BACKGROUND: At the February 4, 2013 Planning and Zoning Commission meeting three <br />public hearings were held to consider the petition of Heritage Ridge Investments, and <br />preliminary and final plats were considered for these subject zoning requests. At that meeting, <br />the commission unanimously recommended approval of all of these items. No one spoke in <br />opposition to the zoning changes. <br />STATUS OF ISSUE: Specifically, the three zoning requests were: (1) a change in zoning from a <br />Planned Development District — c(PD-c) to a Commercial District (C) on Lot 2, City Block 313, <br />located at 3720 Lamar Avenue; (2) a change in zoning from a Commercial District (C) to a <br />Commercial District (C) with a Special Use Permit (49) for auto fuel sales on Lot 2 and 2— E, <br />City Block 313, located at 3720 and 3750 Lamar Avenue; and (3) a change in zoning from a <br />Commercial District (C) to a Commercial District (C) with a Specific Use Permit (49) for auto <br />fuel sales on Lots 5, 6 and 7, City Block 222 — B, located at 2685 Lamar Avenue. The plats for <br />these three projects are scheduled to be on the February 11, 2013 city council meeting. <br />City staff had intended to submit these three zoning cases for public hearings and action by the <br />city council at the February 11, 2013 meeting. In that regard, staff noticed to citizens and <br />published public hearing notices regarding that date. However, after said publication, city staff <br />recognized that it needed additional time to address some technical matters regarding the <br />preparation of the ordinances for these three cases. As a result, the staff intends to bring these <br />projects to the council for action at its February 25, 2013 meeting. <br />Since these projects were legally published/advertised in the newspaper prior to the staff learning <br />that it needs additional time, the appropriate procedure is to have these three cases on the <br />February l lih agenda and have the council pass over (not table) them "to a date certain" — i.e., <br />February 25th.
