Regular Council Meeting <br />February 11, 2013 <br />Page 2 <br />Consent A�enda <br />Mayor Hashmi inquired of Council Members if they wished to pull any items from the <br />Consent Agenda for discussion. Council Member Wright asked for discussion of item 11 and <br />inquired if the west side park on Bonham Street was included in the park plan. Mr. Godwin said <br />it would be included with regard to usage. Mayor Hashmi asked for discussion on item 10. He <br />said that the City of Paris sold certificates of obligation in the amount of $3,500,000 in 2010 for <br />construction of South Collegiate Drive from Loop 286 to Big Sandy Creek Bridge in conjunction <br />with the Texas Department of Transportation's work on FM 1507. Mayor Hashmi said the <br />contract was completed and the contract closed November 12, 2011 and that the remaining fund <br />balance was approximately $951,000. He said the covenants of the certificate of obligations <br />limit the project where the money can be spent. Mayor Hashmi said his understanding of item <br />10 was that the project was for reconstruction between Clarksville Street and the Big Sandy <br />Creek Bridge, a parking lot for the Trail de Paris and a second entrance into the Police and Court <br />Building. He said he was not opposed to this project, but questioned if the remaining funds from <br />the certificates of obligation could be spend on this project. Mr. Napier said the way the bond <br />covenants were set up was from South Collegiate Drive to Loop 286 all the way to Clarksville <br />Street and this portion was included in that. Mayor Hashmi said the documents approved in <br />2010 did not include Clarksville Street. Mr. Napier explained the background paragraph of his <br />memo should have read "from South Collegiate Drive from Loop 286 to Clarksville Street." Mr. <br />Napier said the bond itself went from the Loop to Clarksville Street on South Collegiate. Mr. <br />Anderson read the official statement from the bond and said anything on South Collegiate Drive <br />or anything that fronts South Collegiate Drive is a legal expenditure for those bond proceeds. <br />Mayor Hashmi inquired if the parking lot, road and the extension into the police department were <br />legal expenses. Mr. Anderson said as long as it fronted on South Collegiate and all of those do. <br />Mayor Hashmi asked if staff was sure about it. Mr. McIlyar said based on what Mr. Anderson <br />read, he believed that it would include everything directly adjacent to South Collegiate. Council <br />Member Grossnickle wanted to know if the sports complex parking lot was also part of it. Mr. <br />Godwin said it was not part of this work, but was listed separately on the CIP. Council Member <br />Frierson asked Mr. Anderson if he was reading the actual language and Mr. Anderson answered <br />in the affirmative. Council Member Wright asked if there was a big hurry on this item and Mr. <br />Godwin said he presumed not. Mr. Anderson suggested that staff contact the bond attorney and <br />get something in writing from him. It was a consensus of City Council for staff to contact the <br />bond attorney and bring this item back to the next Council meeting. Council Member Wright <br />wanted to know why the bonds were sold, the money wasn't used and the City paying interest on <br />those bonds. Mr. Anderson explained that after the bonds were sold in 2010, the project bids <br />came in lower than the project estimate and that was why there was remaining money. <br />With the exception of items 6b and 10, a Motion to approve the Consent Agenda was <br />made by Council Member Grossnickle and seconded by Council Member Drake. Motion <br />carried, 7 ayes — 0 nays. <br />5. Approve the minutes from the City Council meeting on January 28, 2013. <br />6.
