APPENDIX E <br />CITY OF PARIS <br />POLICE FACILITY <br />ARTICLE 1.4.2 <br />SPECIAL TERMS AND CONDITIONS OF THE CONTRACT <br />1.4.2.1 CHANGE ORDERS <br />A. Owner-requested Change Orders: The Architect's fees for all work <br />associated with Owner-Requested Change Orders shall be computed on an <br />hourly basis per Appendix "G" schedule. <br />B. Unknown Site Conditions: If the Architect, having used reasonable caze <br />in evaluating eatisting Drawings and field conditions, finds that those <br />existing conditions aze not in accordance with the Construction <br />Documents, therefore requiruig additional work or cost by the Contractor, <br />the cost of the additional or changed work shall be paid by the Owner. <br />The ArchitecYs fee for work associated with such Change Orders shall be <br />computed on an hourly basis per Appendix "G" schedule. <br />C. Omissions: If the Architect fails to include or omits an item from the <br />Contract Documents, which was fixlly anticipated to be included in the <br />Project, thereby necessitating the need for a Change Order, the Architect <br />will not receive a fee for work associated with the Change Order. <br />D. Design Error: If the Architect incorrectly designs or specifies an item <br />which the owner specifically requested to be part of the scope of work and <br />fails to correct the enor prior to installation in the Project, thereby <br />requiring its removal or change, the Architect shall be responsible for the <br />cost to replace said item with the proper item. <br />1.4.2.2 STANDARD OF CARE/CONTINGENCY <br />A. In performing Architectural Services, the Architect will strive to use that <br />degree of care and skill ordinarily exercised under similaz circumstances <br />by competent members of the architecture profession. Notwithstanding <br />compliance with this standard of care, the Owner can normally anticipate <br />that some changes and adjustments in the project will be required either <br />during or after construction. The Owner agrees to establish a contingency <br />fund to cover the reasonably anticipated costs of these changes and <br />adjustments as well as, changes due to code revisions and field conditions. <br />The Owner agrees to not seek costs related to item 1.4.2.1.C omissions <br />from Architect unless the aforementioned contingency funds are exhausted <br />by Non-Owner initiated changes. <br />Page 1 of 2 <br />
