Item No. 14 <br />me�no�andum <br />TO: City Council <br />John Godwin, City Manager <br />FROM: Alan Efrussy, AICP, Planning Manager <br />SUBJECT: RE - ZONING PUBLIC HEARING <br />DATE: March 5, 2013 <br />BACKGROLJND: The applicant, Mr. Kelly Coplin, had previously requested public hearings <br />before both the planning and zoning commission and city council, to consider a change in zoning <br />from a Two Family Dwelling District (2F) to a Multi — Family District No. 2(MF — 2) on Lot 5, <br />City Block 254, being located in the 2100 Block of E. Polk. <br />STATUS OF ISSUE: The applicant has withdrawn this zoning change request after discussions <br />with city staf£ The staff had indicated how he could achieve his positive development goals by <br />not rezoning, while at the same time eliminating the negative aspects of rezoning in the subject <br />neighborhood. Mr. Coplin is now in the process of the procedure to develop this subject <br />property based on the current zoning. However, in order to meet the legal timing requirements <br />for this originally scheduled public hearing, the city staff notified citizens for the planning and <br />zoning commission meeting, and published in the newspaper for the ensuing city council <br />meeting, all before Mr. Coplin withdrew his application. Therefore, legally this rezoning request <br />had to appear on both the commission and council agenda, even though no formal action is <br />required by these bodies. <br />BUDGET: Not applicable. <br />RECOMMENDATION: Council announce that the applicant has withdrawn his rezoning <br />application, and the council recognizes that no other action is required at this time. <br />_�. �.1 <br />
