TX LOCAL GOVT § 214212 Page 3 <br />V.T.C.A., Local Govemment Code § 214212 <br />"Sec. 3. (a) Subchapter G, Chapter 214, Local Govemment Code, as added by this Act, applies only to residential <br />construction, remodeling alteration, or repair that begins under an agreement made on or after January 1, 2002, or <br />that begins, in the absence of an agreement, on or after that date. Residential construction, remodeling alteration, or <br />repair that begins under an agreement made before January 1, 2002, or that begins, in the absence of an agreement, <br />before that date is govemed by the law in effect when the agreement was made or the activity began, as appropriate, <br />and that law is continued in effect for that purpose. <br />"(b) Municipalities shall, before January 1, 2002, establish rules and take other necessary actions to implement <br />Subchapter G, Chapter 214, Local Govemment Code, as added by this Act. <br />"Sec. 4. This Act takes effect January 1, 2002, except that Subsection (b), Section 3 of this Act, and this section take <br />effect September 1, 2001." <br />NOTES OF DECISIONS <br />Plumbing 1 <br />1. Plumbing <br />Pursuant to Texas Local Govemment Code chapter 214, subchapter G, the Intemational Residential Code is the <br />uniform residential building code for municipalities in this state, and its plumbing provisions are the uniform <br />plumbing code for residential construction. The Plumbing Licensing Law permits the adoption by the Board of <br />Plumbing Examiners of two plumbing codes, the Intemational Plumbing Code and the Uniform Plumbing Code, <br />either of which municipalities may choose to govem nonresidential plumbing. Cities of fewer than 5,000 inhabitants <br />may, but are not required to, adopt a plumbing code pursuant to the Plumbing Licensing Law. Plumbing installation <br />in a political subdivision that has adopted a plumbing code under that law must be inspected by a licensed plumbing <br />inspector. OpAtty.Gen2002, No. JC-0453. <br />V.
