AGENDA INFORMATION SHEET <br />MAY 30, 2002 <br />SUBJECT: Conduct a public hearing and consider an ordinance repealing the City's existing ordinance <br />on substandard buildings and consider enactment of a new Ordinance amending Chapter 7 ofthe Paris Code <br />of Ordinances consistent with state law regarding vacant substandard buildings and structures and the <br />abatement of such nuisance. <br />BACKGROUND: As the City Council is aware, the Council has been deliberating a proposed substandard <br />building ordinance and at the last City Council meeting requested a special meeting for the purpose of <br />conducting another public hearing and to further deliberate the proposed ordinance. Since that time, the <br />Legal Deparhnent has provided City Council a hard copy of the same Ordinance contained in computer <br />form for the May 13, 2002 City Council meeting. In an attempt to address some of the concerns raised by <br />Council Members at the May 13 meeting, the Legal Deparhnent has made certain discrete proposed <br />revisions to the attached draft included in this package. Those changes are highlighted in the text of the <br />enclosed ordinance. <br />DESCRIPTION: The changes to the proposed Ordinance are not extensive, and may be summarized as <br />follows: <br />All references to time periods and days have been changed to refer to calendar days. <br />2. On page 4 of the proposed Ordinance, a new definition has been added to clarify that the Building <br />Standards Commission will only be able to issue orders for the vacation of a building if those <br />persons ordered to vacate the building are individuals other than the owner, the lessee, or invitees <br />of the owner or lessee. This change should make it very clear that only buildings that are vacant or <br />occupied by transients will be subject to the ordinance. <br />3. All reference to relocation of occupants has been removed (see pages 2, 11, 13, 14, 15, and 16 of <br />the Ordinance). This change is also intended to reflect the intent of the Ordinance to address only <br />vacant buildings. Other than these discrete changes, the ordinance remains essentially the same as <br />was provided earlier. The earlier agenda information sheets describing the prior drafts are also <br />included in this package. <br />RECOMMENDED ACTION: Receive a report by the City's code inspectors regarding substandard <br />buildings in the City, conduct a public hearing on the proposed Ordinance, and further deliberate the <br />Ordinance. <br />STAFF CONTACT: Larry W.
