Inemo�andum <br />TO: City Council <br />John Godwin, City Manager <br />FROM: Alan Efrussy, AICP, Planning Manager <br />SUBJECT: ZONING PUBLIC HEARING FOR 2965 SOUTH CHURCH STREET <br />DATE: May 7, 2013 <br />BACKGROUND: This application is for a public hearing regarding the petition of Kwik Check <br />#34 for a change in zoning from Agricultural District (A) to a Commercial District (C) on Lot 3, <br />City Block 341 and Tract 26 of J. Bourland Survey A#69, being located at 2965 South Church <br />Street. The applicant is Taylor-Smart LLC and the property owner is Doyce Taylor of Paris, <br />Texas. The subject property is comprised of 2.424 acres. At its May 6, 2013 meeting, the Paris <br />Planning and Zoning Commission voted unanimously to recommend approval of this zoning <br />change request. <br />STATUS OF ISSUE: The city staff has determined the following findings: <br />(A) Existin�Land Use: The surrounding property is characterized by commercial land use <br />and a sand and gravel yard facility. <br />(B) Existing Zoning of the Subject Property: The current zoning of the subject property is <br />both Commercial District (C) and Agricultural District (A). <br />(C) Proposed Zoning of the Subject Property: The proposed use of the subject property is for <br />a convenience store, and the Commercial District (C) allows this as a permitted use. <br />Since a portion of this property is already zoned (C), this request is a logical extension of <br />an existing, consistent, zoning district. <br />(D) The Future Land Use P1an�FLUP� within the Comprehensive Plan: The FLUP <br />recommends that all of this subject property be developed as "R" (Retail) and this <br />proposed use is compatible with that land use category. <br />BUDGET: N/A <br />.- 45 <br />
