DRAFT <br />J:\Attorney\ALICE\RESWORK\CiJRRENT\3rd St. SE convey Res.wpd <br />August 30, 2002 <br />RESOLUTION NO. <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, <br />PARIS, TEXAS, AUTHORIZING THE EXECUTION OF DEEDS OF <br />ABANDONMENT TO THE ADJACENT PROPERTY OWNERS OF AN 80 <br />FOOT STREET KNOWN AS 3RD STREET S.E., ABANDONED BY <br />ORDINANCE NO. 2002- FROM THE NORTH BOUNDARY LINE OF <br />PARIS BOULEVARD NORTH TO THE SOUTH BOUNDARY LINE OF <br />SYCAMORE STREET; MAKING OTHER FINDINGS AND PROVISIONS <br />RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. <br />WHEREAS, it has been called to the attention of the City Council of the City of Paris <br />that there is a street known as 3rd Street S.E. running north and south, beginning at the north <br />boundary line of Paris Boulevard going north to the south boundary line of Sycamore Street; <br />and, <br />WHEREAS, it has been called to the attention of the City Council by petition of the <br />adjacent property owners that the street is no longer necessary or desirable by the property <br />owners adj acent to said street, but said street is of use and necessary to the City of Paris and its <br />citizens for drainage and utility easement purposes; and, <br />WHEREAS, the City Council, by prior Ordinance No. 2002- adopted September <br />5, 2002, has authorized the City to abandon the City's interest in the aforesaid street; and; <br />WHEREAS, it is deemed appropriate that the City's interest in said street be conveyed <br />to the adj acent owners on either side of said street and that drainage and utility easements be <br />retained; NOW, THEREFORE, <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, <br />TEXAS: <br />Section 1. That the findings set out in the preamble to this resolution are hereby in all <br />things approved. <br />Section 2. That the Mayor of the City of Paris, be, and he is hereby, authorized and <br />directed to execute, on behalf of the City of Paris, deeds of abandonment conveying to the <br />adjacent owners on either side of said 3rd Street S.E., in accordance with the laws of the State <br />of Texas, the City's interest in the abandoned street located between the north boundary line of <br />Paris Boulevard going north to the south boundary line of Sycamore Street, it appearing that the <br />real and true owners of the hereinafter described lots are as follows: <br />
