DRAFT <br />J:\Attorney\ALICE\RESWORK\CiJRRENT\Simmons Dr Clsg Convey Res.wpd <br />August 30, 2002 <br />RESOLUTION NO. <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, <br />PARIS, TEXAS, AUTHORIZING THE EXECUTION OF DEEDS OF <br />ABANDONMENT TO THE ADJACENT PROPERTY OWNERS OF A FIFTY <br />(50) FOOT WIDE STREET KNOWN AS COUNTY ROAD 42602, AND ALSO <br />KNOWN AS SIMMONS DRIVE, IN THE EAST SUBURBAN ESTATES <br />ADDITION ABANDONED BY ORDINANCE NO. 2002- FROM THE <br />WEST BOUNDARY LINE OF MOCKINGBIRD LANE GOING WEST <br />APPROXIMATELY 150 FEET TO THE END OF SAID SIMMONS DRIVE, <br />BETWEEN PINE MILL ROAD AND NOLES DRIVE; MAKING OTHER <br />FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND <br />PROVIDING AN EFFECTIVE DATE. <br />WHEREAS, it has been called to the attention of the City Council of the City of Paris <br />that there is a street known as County Road 42602, and also known as Simmons Drive, in the <br />East Suburban Estates Addition running east and west, beginning at the west boundary line of <br />Mockingbird Lane going west a distance of 150 feet to the end of said Simmons Drive, located <br />between Pine Mill Road and Noles Drive; and, <br />WHEREAS, it has been called to the attention of the City Council by petition of the <br />property owners that the street is not desired by the property owners adj acent to said street and <br />said street is of no use or necessity to the City of Paris and its citizens; and, <br />WHEREAS, the City Council, by prior Ordinance No.2002- , adopted September <br />5, 2002, has authorized the City to abandon the City's interest in the aforesaid street; and, <br />WHEREAS, it is deemed appropriate that the City's interest in said street be conveyed <br />to the adj acent owners on either side of said street; NOW, THEREFORE, <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, <br />TEXAS: <br />Section 1. That the findings set out in the preamble to this resolution are hereby in all <br />things approved. <br />Section 2. That the Mayor of the City of Paris be, and he is hereby, authorized and <br />directed to execute, on behalf of the City of Paris, deeds of abandonment conveying to the <br />adj acent owners on either side of said street, in accordance with the laws of the State of Texas, <br />the City's interest in the abandoned street located between Pine Mill Road and Noles Drive in <br />East Suburban Estates Addition, beginning at the west boundary line of Mockingbird Lane <br />
