DRAFT <br /> <br />F:kAttorney\LisahO. esolutions\CURRENT~PW - Rear Loader Res.wpd <br /> February 6, 2003 <br /> <br />RESOLUTION NO. <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, <br />PARIS, TEXAS, APPROVING THE PURCHASE OF A ONE (1) MODEL <br />YEAR 2003 MCNELLUS 20 YARD METROPAK REAR LOADER WITH <br />CAB AND CHASSIS FOR USE IN THE SANITATION DIVISION OF THE <br />PUBLIC WORKS DEPARTMENT THROUGH THE HOUSTON- <br />GALVESTON AREA COUNCIL OF GOVERNMENTS, SUBJECT TO THE <br />CITY OBTAINING ACCEPTABLE FINANCING TERMS FROM OUTSIDE <br />SOURCES; AUTHORIZING THE CITY MANAGER AND THE DIRECTOR <br />OF PUBLIC WORKS TO OBTAIN SUCH FINANCING; AUTHORIZING <br />THE EXECUTION OF A LEASE PURCHASE AGREEMENT AND ANY <br />AND ALL OTHER NECESSARY DOCUMENTS RELATED TO THE <br />TRANSACTION APPROVED HEREIN; MAKING OTHER FINDINGS AND <br />PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN <br />EFFECTIVE DATE. <br /> <br /> WHEREAS, the City Council has been a member of the Cooperative Purchasing Program <br />through the Houston-Galveston Area Council of Governments since October 1, 1990; and, <br /> <br /> WHEREAS, it is deemed appropriate that the City of Paris purchase a one (1) Model Year <br />2003 McNellus 20 Yard MetroPak Rear Loader with Cab and Chassis for use in the Sanitation <br />Division of the Public Works Department through said Houston-Galveston Area Council of <br />Governments; and, <br /> <br /> WHEREAS, it is further deemed appropriate that the City Manager be authorized to execute <br />a Lease Purchase Agreement for one (1) Model Year 2003 McNellus 20 Yard MetroPak Rear Loader <br />with Cab and Chassis for a total purchase price of $87,592.99, which represents the cost of the rear <br />loader, which is $86,114.00, plus the cost of the Houston-Galveston Area Council of Governments <br />fee, which is $1,478.99, subject to the city obtaining acceptable financing terms from outside sources; <br />NOW, THEREFORE, <br /> <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, <br />TEXAS: <br /> <br /> Section 1. That the findings set out in the preamble to this resolution are hereby in all things <br />approved. <br /> <br /> Section 2. That the City Manager be, and he is hereby, authorized and directed to execute, <br />on behalf of the City of Paris, a Lease Purchase Agreement, upon such terms and conditions and in <br />such form as approved by the City Attorney, at the price of $87,592.99, which represents the cost <br /> <br /> <br />
