Regular City Council Meeting <br />February 10, 2003 <br />Page 7 <br /> <br />their comp time and the only way that could vary is if the City Council voted to <br />do something different. <br /> <br />Councilman Plata said he thought that when Earl Smith left the employment of <br />the City of Paris, he received pay for comp time. Mr. Anderson advised that Mr. <br />Smith did not get paid for any comp time that he had accrued. Mr. Anderson <br />advised that Mr. Smith did have vacation time accrued and he did get paid for <br />that. Mr. Anderson explained that under the policy, upon termination, an <br />employee can only be paid for thirty days of vacation time. The policy does not <br />prevent them from taking vacation time prior to the termination date. <br /> <br />He explained that the other issue brought up was sick leave. The policy says <br />people can be paid for sick leave if they are sick or someone in their immediate <br />family is sick. The only exception to that rule are the civil service employees, <br />which are policemen and firemen. Under civil service, they can be paid up to 90 <br />days of sick leave when they leave the employment of the city. He said that no <br />employee, other than civic service employees, are paid for sick leave when their <br />employment is terminated. <br /> <br />On the request of Councilman McCarthy, Mr. Anderson explained that once the <br />city received Earl Smith's formal termination of employment he drew no pay. <br />He was paid an amount of accumulated vacation time after he made his move. <br />This was allowed because Mr. Smith was not replaced right away and the City <br />needed him for several things such as his expertise in a lawsuit. There were <br />several Engineering projects that required the services of a professional engineer <br />in order to continue. Mr. Smith made numerous trips back to the city for <br />meetings and he was not paid for the travel or for his time. <br /> <br />City Attorney Schenk pointed out that on Page 4 of the revised contracts the <br />words "sick leave", "compensatory time", and "all" before "accrued vacation" <br />have been omitted. That portion now reads "shall be entitled to receive <br />compensation for accrued vacation and all other compensation benefits afforded <br />other City employees of similar longevity pursuant to the City's Personnel <br />Policy" have been inserted. <br /> <br /> <br />
