A motion was made by Councilman Bell for
approval of the Preliminary Plat, subject to the engineer' s recommendations with
the exception of any requirements for curb and cutter. The motion was seconded
by Councilman Guest.

City Manager Malone advised that the city has required curb and gutter
construction or a deposit of other developers and money has been collected for
that purpose. City Attorney Schenk advised that it would be inconsistent with the
requirements of the ordinance as it is written now. City Engineer Shawn Napier
said that based on what they have been doing, that requirement is city policy as
indicated in the handout. It says curb and gutter shall be constructed along both
sides of all streets and avenues within the subdivision, which is very standard.
He advised that the standards also say curb and gutter is required along all
boundary streets and that is where we arrived at the decision concerning this
