<br /> E. Continuity and Quality of Gas Service
<br />
<br /> (1) Company will make all reasonable efforts to prevent interruptions of service to
<br /> Residential and Commercial Customers. When residential and/or commercial
<br /> interruptions occur, Company will re-establish service within the shortest reasonable time
<br /> consistent with prudent operating principles so that the smallest number of Residential
<br /> and Commercial Customers is affected. Company will make reasonable provisions to
<br /> meet emergencies resulting from failure of .residential and commercial service and will
<br /> issue instructions to its employees covering procedures to be followed in the event of an
<br /> emergency in order to prevent or mitigate interruption or impairment of service to
<br /> Residential and Commercial Customers. In the event of national emergency or local
<br /> disaster resulting in disruption of normal service, Company may, in the public interest,
<br /> interrupt service to other Customers to provide necessary service to civil defense or other
<br /> emergency service agencies on a temporary basis until normal service to these agencies
<br /> can be restored.

<br /> (2) When any Customer is notified by Company to do so, such Customer will curtail,
<br /> interrupt, reduce, limit, terminate, or discontinue the use of Gas Service in accordance
<br /> with Company's curtailment program approved by the applicable Regulatory Authority. In
<br /> the event of any such curtailment, interruption, reduction, limitation, termination, or
<br /> discontinuation of Gas Service, Company personnel may enter Customer's premises and
<br /> physically turn off the gas or reduce the quantity of gas serving Customer, and no one
<br /> other than Company's personnel will thereafter be permitted to increase the quantity of
<br /> gas or turn the Gas Service back on. Customer will assume any and all risks, including,
<br /> but not limited to, lost profits, damaged or destroyed facilities, lost or damaged
<br /> production, damaged or destroyed machinery and/or equipment, and the failure of a
<br /> facility or equipment of Customer and/or Customer's business due to a curtailment,
<br /> interruption, reduction, limitation, termination, or discontinuation of Customer's Gas
<br /> Service in accordance with Company's curtailment program approved by the applicable
<br /> Regulatory Authority. Customer will indemnify and hold Company harmless from
<br /> and against any and all damages, costs, losses, and expenses (including
<br /> reasonable attorneys' fees) that may be sustained by Customer due to any claim,
<br /> demand, suit, or action brought against Company (whether or not the claim,
<br /> demand, suit, or action is found to be valid) by any person or entity arising out of,
<br /> resulting from, or connected, in whole or in part, with, a curtailment, interruption,
<br /> reduction, limitation, termination, or discontinuation of Gas Service in accordance
<br /> with Company's curtailment program approved by the applicable Regulatory
<br /> Authority.
<br />
<br /> (3) Customer will be responsible for installing and maintaining protective devices as
<br /> are necessary to protect Customer's equipment or processes during irregular or
<br /> interrupted service, or the failure of part or ale of the Gas Service. in those instances
<br /> where Customer experiences interruptions to all or part of the Gas Service of an
<br /> undetermined cause and the report of the same to Company prompts a visit to
<br /> Customer's premises at Customer's request and it is determined that the interruption or
<br /> irregularity resulted from Customer's facilities, Company may charge Customer an
<br /> amount based on the cost to Company for such a visit.
