Company will not be required Io establish new Delivery <br /> Point(s) or ,ncrease delivery capacity at an existing Delivery Point un~ess additional firm capac;ty is <br /> available on the portion of Company's system on which additional capacity ~s requested. <br /> (b} Overrun Capacity. In the event Customer requires capacity on a short-term basis ~n <br /> excess of Customer's then-applicable daity or hourly delivery capacities in order to ma~ntam firm detivery <br /> service to its residential and commercial customers, Company will make available to Customer, upon <br /> request by Customer, on a pro rata basis with other City Gate Customers, any then exJstmg ~nterruptible <br /> capacity ~n the vicinity of the affected Delivery Point(s), but only to the extent that such ~nterruptibie <br /> capaoty is necessary for Customer to maintain service to Customer's residential and commercial <br /> customers, <br /> (c) Projected Usage Profile. On or before October 1st of each year, Customer must furnish <br /> to Company an annual usage profile showing estimated totaI monthly quantities to be transported under <br /> each applicable Transportation Agreement during the follow~ng calendar year. tn addition, on or before <br /> October 1st of each year, Customer must furnish to Company an estimate of peak day quantities to be <br /> transported under the applicable Transportation Agreement to each Delivery Pomt during the following <br /> calendar year. The annual usage profile will not be used to adjust daily or hourly delivery capacities <br /> under paragraph 4(a). <br /> (d) Storage Capacity. Customer will have the right to have up to the quantity of Gas <br /> identified on the applicable Transportation Agreement stored in Company's Primary and Secondary <br /> Storage Facilities identified on the applicable Transportation Agreement. If changed levels of daily <br /> delivery capacities become effective under paragraph 4(a), then Customer's storage capacities, ~njection <br /> rights, and withdrawal rights will be increased in the same proportion as such change to Customer's daily <br /> delivery capacity. <br /> (e) Injection Rights. Customer will have the right to inject into storage under any appIicable <br /> Transportation Agreement up to the maximum daily injection volumes set forth in the applicable <br /> Transportation Agreement. Simultaneous injection and withdrawal nominations will be allowed by <br /> Company if pipeline system operations and pressures permit. The actual operating capabilities of <br /> Company's pipeline and storage facilities may allow for the maximum injection nominations set forth ~n <br /> the applicable Transportation Agreement to be waived, in whole or in part by Company, from time to time, <br /> Accordingly, Company may from time to time advise Customer of its daily operating conditions, and, to <br /> the extent permitted by such actual operating conditions, Customer may nominate volumes of Gas in <br /> excess of the maximums set forth in the applicable Transportation Agreement. <br /> (f) Withdrawal Rights. Customer will have the right to withdraw from storage under any <br />applicable Transportation Agreement up to the maximum daily withdrawal volumes established in the <br />applicable Transportation Agreement. Customer's withdrawal rights will be determined by the then- <br />existing inventory of Customer's Gas in Primary and Secondary Storage Facilities as set forth in the <br />applicable Transpo,lation Agreement. Customer's totat storage withdrawal nominations for any Day will <br />not exceed the lesser of ti) 70% of Customer's estimated daily demand, or (ii) the maximum withdrawal <br />based on Customer's inventory as set forth in the applicable Transportation Agreement. The actual <br />operating capabilities of Company's pipeline and storage facilities may allow for the maximum withdrawal <br />nominations set forth in the applicable Transportation Agreement to be waived, in whole or in part by <br />Company, from time to time. Accordingly, Company may from time to time advise Customer of its daily <br />operating conditions, and, to the extent permitted by such actual operating conditions, Customer may <br />nominate volumes of Gas in excess of the maximums set forth in the applicable Transportation <br />Agreement. <br /> <br /> -92- <br /> <br /> <br />
