interest of all parties; and, including the above - mentioned consideration, that the division of <br />cost /labor fairly compensates the performing party for the services under this contract; <br />NOW, THEREFORE, the parties do hereby agree as follows: <br />ARTICLE 1: SCOPE OF AGREEMENT <br />The parties agree to make available their law enforcement personnel for assistance, investigation <br />and the performance of any and all duties of law enforcement related to drug related offenses <br />outside of each party's home jurisdiction of another party to this agreement if requested by each <br />party's respective Chief of Police, Sheriff, or designee. <br />ARTICLE 2: FOREFEITURE OF CONTRABAND PURSUANT TO CHAPTER 59 OF <br />THE TEXAS CODE OF CRIMINAL PROCEDURE <br />All parties agree that proceeds from forfeiture of contraband (seized under actions taken pursuant <br />to this Agreement) pursuant to Chapter 59 of the Texas Code of Criminal Procedure shall be <br />governed by the standing agreement between the Lamar County District Attorney's office and <br />the agency that instigated the investigation. <br />ARTICLE 3: LEGAL AUTHORITY <br />All parties represent that they are eligible to participate in this Agreement as a local government, <br />as defined in the Act, and possess adequate legal authority to enter into this Agreement. <br />ARTICLE 4: APPLICABLE LAWS <br />The parties agree to conduct all activities under this Agreement in accordance with all applicable <br />rules, regulations and ordinances and laws in effect or promulgated during the term of this <br />Agreement in Lamar County, Texas and within the municipalities of Paris, Texas and Reno, <br />Texas. <br />ARTICLE 5: WHOLE AGREEMENT <br />This agreement and any attachments, as provided herein, constitute the complete contract <br />between the parties hereto, and supersede any and all oral and written agreements between the <br />parties herein. <br />ARTICLE 6: CHANGES AND AMENDMENTS <br />This agreement may be amended only by a written amendment executed by the parties, except <br />that any alterations, additions, or deletions to the terms of this Agreement which are required by <br />changes in Federal and State law or regulations are automatically incorporated into this <br />Agreement without written amendment hereto and shall become effective on the date designated <br />by such law or regulation. <br />ARTICLE 7: EFFECTIVE DATE AND TERM <br />This agreement will become effective as of the date last executed by the Parties hereto.
