Pipeline Road <br />Hurst, Texas 76053 <br /> <br />SUBJECT: Paris Retirement Village Curb and Gutter <br /> <br /> This is in response to our phone conversation January 13, 2004. We are in agreement <br />that the curb and gutter on 13th St. S.W. and Brame (adjacent to the development) is needed and <br />that you will build that portion. We are also in agreement that the section of curb and gutter <br />along W. Washington St. should not be constructed. The main reason for not building the curb <br />and gutter is that when the road is reconstructed it will need to be lowered and if you built curb <br />and gutter it would have to be removed as part of that project. The North ditch line of <br />Washington St. drains an area starting East of 13th S.W. St. and into a culvert at the intersection <br />of 13th S.W. St. and W. Washington. If curb and gutter were constructed along the part of <br />Washington St. adjacent to the development additional work would need to be performed by the <br />city to remedy this problem. <br /> The guarantee of construction portion of the Code of Ordinances requires that the <br />developer put up money in lieu of actually completing the construction work in order to file the <br />final plat. This assumes that the developer will come back and complete the work within a <br />seven-year period. It is my understanding that you as the developer in this case do not want to <br />construct the curb and gutter. Only the City Council can waive the construction of curb and <br />gutter or waive putting money into an account for the construction of the curb and gutter. <br /> The only thing ! can allow you to do is to put money into an account for the construction <br />of the curb and gutter along W. Washington Street. Any other disposition of the curb and gutter <br />cost will have to be presented to the City Council, and must be requested in advance in writing <br />by the developer.
