APPENDL~ B--SUBDWISION REGULATIONS Ord. No. 1315, <br /> <br />in lieu of actually completing the construction of <br />the improvements required by this ordinance as a <br />predicate to the approval of the final map or plat <br />of the same, file with the City of Paris a corporate <br />surety bond, executed by said owner or developer <br />as principal and approved surety company li- <br />censed to do business in the State of Texas, as <br />surety, in a sum equal to the estimated cost of <br />such improvements, which said bond shall guar- <br />antee the construction thereof within the time <br />stated in said bond, which shall never exceed <br />seven (7) years. Such bond shall specifically state <br />it shall remain in full force and effect, regardless <br />of the time, until such improvements are made <br />and accepted by the City of Paris as having been <br />constructed in accordance with the requirements <br />of this ordinance. Such bond shall be approved by <br />the city attorney. <br /> <br /> The developer and owner shall guarantee the <br /> workmanship and materials used in the construc- <br /> tion and installation of water mains, sanitary <br /> sewer mains and street paving within the subdi- <br /> vision for one (1) year from the date of completion <br /> of all of such improvements as certified to by the <br /> city on,neet of the City of Paris, which period <br /> shall be in addition to the period of guarantee <br /> provided for in section IV(11). <br /> (Ord. No. 2439, § 11, 3-12-79) <br /> <br />Section XIV. Prohibiting Expenditure of <br /> Public Funds. <br /> <br /> The approval of any plan, plat or replat by the <br />Commission shall not be deemed an acceptance of <br />the dedication of streets, alleys, parks, easements <br />and other public places therein and thereby ded- <br />icated, and shall not impose any duty upon the <br />City of Paris concerning the maintenance, or <br />improvement of any such dedicated areas or facil- <br />itles, unless and until the same have been accept- <br />ed' by the City of Paris by the formal action of a <br />majority of the city council in regular or special <br />session convened. Unless and until the dedicated <br />streets, alleys, parks, easements, public places, <br />water and sewer line shown on any such plan, <br />plat or replat shall have been first accepted by the <br />city council of the City of Paris, as in the manner <br />aforesaid, it shall be unlawful for any official of <br />the City to serve or connect any part or portion of <br /> <br />the proper~y covered by such plan, plat or replat <br />with any public utility which may be owned, <br />controlled or distributed by the City of Paris. <br /> <br />Section XV. Schedule of Fees. <br /> <br /> The follo~ving schedule of fees and charges <br />shall be collected by the Director of Public Works <br />when any preliminary map or plat is tendered to <br />the City for consideration. Each of the fees and <br />charges provided for herein shall be paid in ad- <br />vance, and no action of the Commission shall be <br />valid until the fees, herein provided, shall have <br />been paid. <br /> <br /> (1) Preliminary Plat. Five dollars ($5.00) per <br /> plat plus fifty cents (50¢) per lot. <br /> <br /> (2) Final Plat. No charge. <br /> <br /> (3) Replats. Five dollars ($5.00) per replat, in <br /> the event no preliminary plat is required. <br /> If preliminary plat is required the fee <br /> shall be the same as (1). <br /> <br />Section XVI. Changes and Variations. <br /> <br /> (A) These rules and regulations are the stan- <br />dard requirements of the City of Paris. <br /> <br /> (B) A suspension from or a variation of any of <br />these rules and regulations may be recommended <br />by the commission, upon a showing by the owner <br />or developer that there are special circumstances <br />or conditions affecting the property in question; <br />that enforcement of the provisions of this ordi- <br />nance will deprive the applicant of a substantial <br />property right; and that such suspension, if granted, <br />will not be materially detrimental to the public <br />welfare or injurious to other property or property <br />rights in the vicinity. Upon recommendation of a <br />suspension of any of these rules and regulations <br />by the commission, the city council may, upon <br />finding that there are special circumstances or <br />conditions affecting the property in question; that <br />enforcement of the provisions of this ordinance <br />will deprive the applicant of a substantial prop- <br />erty right; and that such suspension, if granted, <br />will not be materially detrimental to the public <br />welfare or injurious to other property or property <br />rights in the vicinity, grant a suspension of any of <br />these rules and regulations.
